    Amends the Illinois Municipal Code. Makes a technical change in a Section concerning auxiliary police officers.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5changing Section 3.1-30-20 as follows:
 
6    (65 ILCS 5/3.1-30-20)  (from Ch. 24, par. 3.1-30-20)
7    Sec. 3.1-30-20. Auxiliary police officers.
8    (a) Auxiliary police officers shall not be members of the
9the regular police department of the municipality. Auxiliary
10police officers shall not supplement members of the regular
11police department of any municipality in the performance of
12their assigned and normal duties, except as otherwise provided
13in this Code. Auxiliary police officers shall only be assigned
14to perform the following duties in a municipality: (i) to aid
15or direct traffic within the municipality, (ii) to aid in
16control of natural or man made disasters, and (iii) to aid in
17case of civil disorder as directed by the chief of police. When
18it is impractical for members of the regular police department
19to perform those normal and regular police duties, however,
20the chief of police of the regular police department may
21assign auxiliary police officers to perform those normal and
22regular police duties. Identification symbols worn by
23auxiliary police officers shall be different and distinct from

1those used by members of the regular police department.
2Auxiliary police officers shall at all times during the
3performance of their duties be subject to the direction and
4control of the chief of police of the municipality. Auxiliary
5police officers shall not carry firearms, except with the
6permission of the chief of police and while in uniform and in
7the performance of their duties. Auxiliary police officers,
8when on duty, shall also be conservators of the peace and shall
9have the powers specified in Section 3.1-15-25.
10    (b) Auxiliary police officers, before entering upon any of
11their duties, shall receive a course of training in the use of
12weapons and other police procedures appropriate for the
13exercise of the powers conferred upon them under this Code.
14The training and course of study shall be determined and
15provided by the corporate authorities of each municipality
16employing auxiliary police officers. Before being permitted to
17carry a firearm, however, an auxiliary police officer must
18have the same course of training as required of peace officers
19under Section 2 of the Peace Officer and Probation Officer
20Firearm Training Act. The municipal authorities may require
21that all auxiliary police officers be residents of the
22municipality served by them. Before the appointment of an
23auxiliary police officer, the person's fingerprints shall be
24taken, and no person shall be appointed as an auxiliary police
25officer if that person has been convicted of a felony or other
26crime involving moral turpitude.

1    (c) The Line of Duty Compensation Act shall be applicable
2to auxiliary police officers upon their death in the line of
3duty described in this Code.
