AN ACT concerning State government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Criminal Justice Information Act is amended by adding Section 9.4 as follows:

(20 ILCS 3930/9.4 new)

Sec. 9.4. Statewide Deferred Prosecution Funding Program. The Statewide Deferred Prosecution Funding Program Fund is hereby created as a special fund in the State treasury. Grants from the Fund shall be made, subject to appropriation, by the Illinois Criminal Justice Information Authority to State's Attorneys upon application in the amount of 25% of the costs incurred by the county to operate the deferred prosecution program. To be eligible to receive moneys from the Fund, a State's Attorney must provide a deferred prosecution program that allows for a misdemeanor charge to be dismissed upon successful completion of the deferred prosecution program created by the State's Attorney. The Authority shall by rule provide selection criteria and procedures for grants to be made under this Section.

Section 90. The State Finance Act is amended by adding Section 5.935 as follows:
