SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-13-28 new

    Amends the Illinois Municipal Code. Provides that, in exercising its zoning powers, a municipality may regulate the storage of hazardous materials that are to be transported in compliance with the Illinois Hazardous Materials Transportation Act. Provides that, if an entity, or agent of the entity, engaged in the business of transporting hazardous material has filed a petition for a variance or special use, a municipality shall require the entity or agent to disclose the types of hazardous materials to be transported into and stored in a facility and an estimate of the number of freight vehicles expected to enter and exit the site on a regular basis.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5adding Section 11-13-28 as follows:
 
6    (65 ILCS 5/11-13-28 new)
7    Sec. 11-13-28. Storage of hazardous material.
8    (a) As used in this Section, "hazardous material" and
9"transportation" have the meanings given to those terms in
10Section 3 of the Illinois Hazardous Materials Transportation
11Act.
12    (b) In exercising the powers under this Division, a
13municipality may regulate the storage of hazardous materials
14that are to be transported in compliance with the Illinois
15Hazardous Materials Transportation Act. If an entity, or agent
16of the entity, engaged in the business of transporting
17hazardous material has filed a petition for a variance or
18special use, a municipality shall require the entity or agent
19to disclose the types of hazardous materials to be transported
20into and stored in a facility and an estimate of the number of
21freight vehicles expected to enter and exit the site on a
22regular basis.
