SYNOPSIS AS INTRODUCED:
 
225 ILCS 60/49  from Ch. 111, par. 4400-49

    Amends the Medical Practice Act of 1987. Provides that a person who does not possess a valid license and uses the title Anesthesiologist or Dermatologist violates the Act.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Medical Practice Act of 1987 is amended by
5changing Section 49 as follows:
 
6    (225 ILCS 60/49)  (from Ch. 111, par. 4400-49)
7    (Section scheduled to be repealed on January 1, 2027)
8    Sec. 49. If any person does any of the following and does
9not possess a valid license issued under this Act, that person
10shall be sentenced as provided in Section 59: (i) holds
11himself or herself out to the public as being engaged in the
12diagnosis or treatment of physical or mental ailments or
13conditions including, but not limited to, deformities,
14diseases, disorders, or injuries of human beings; (ii)
15suggests, recommends or prescribes any form of treatment for
16the palliation, relief or cure of any physical or mental
17ailment or condition of any person with the intention of
18receiving, either directly or indirectly, any fee, gift, or
19compensation whatever; (iii) diagnoses or attempts to
20diagnose, operates upon, professes to heal, prescribes for, or
21otherwise treats any ailment or condition, or supposed ailment
22or condition, of another; (iv) maintains an office for
23examination or treatment of persons afflicted, or alleged or

1supposed to be afflicted, by any ailment or condition; (v)
2manipulates or adjusts osseous or articular structures; or
3(vi) attaches the title Doctor, Physician, Surgeon, M.D., D.O.
4or D.C., Anesthesiologist, or Dermatologist or any other word
5or abbreviation to his or her name indicating that he or she is
6engaged in the treatment of human ailments or conditions as a
7business.
8    Whenever the Department has reason to believe that any
9person has violated this Section the Department may issue a
10rule to show cause why an order to cease and desist should not
11be entered against that person. The rule shall clearly set
12forth the grounds relied upon by the Department and shall
13provide a period of 7 days from the date of the rule to file an
14answer to the satisfaction of the Department. Failure to
15answer to the satisfaction of the Department shall cause an
16order to cease and desist to be issued immediately.
