SYNOPSIS AS INTRODUCED:

720 ILCS 5/19-2.1 new

Amends the Criminal Code of 2012. Creates the offense of possession of a relay vehicle theft device. Provides that a person commits the offense when he or she knowingly possesses a relay vehicle theft device. Exempts from a violation: (1) an employee of a facility subject to the Automotive Repair Act or the Automotive Collision Repair Act; (2) a new vehicle dealer or used vehicle dealer licensed under the Illinois Vehicle Code; (3) a locksmith licensed under the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act of 2004; (4) a repossession agent; or (5) a federal, State, or local law enforcement officer. Provides that possession of a relay vehicle theft device is a Class 3 felony. Defines "relay vehicle theft device". Effective immediately.

A BILL FOR

AN ACT concerning criminal law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Criminal Code of 2012 is amended by adding Section 19-2.1 as follows:

(720 ILCS 5/19-2.1 new)

Sec. 19-2.1. Possession of a relay vehicle theft device.

(a) In this Section, "relay vehicle theft device" means a device designed to capture a signal from the key fob of a motor vehicle to unlock and start the motor vehicle without the use or possession of the motor vehicle key.

(b) A person commits possession of a relay vehicle theft device when he or she knowingly possesses a relay vehicle theft device.

(c) This Section does not apply to:

(1) an employee of a facility subject to the Automotive Repair Act or the Automotive Collision Repair Act;

(2) a new vehicle dealer or used vehicle dealer licensed under Section 5-101 or 5-102 of the Illinois Vehicle Code;

(3) a locksmith licensed under the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act of 2004;

(4) a repossession agent; or

(5) a federal, State, or local law enforcement officer.

(d) Sentence. Possession of a relay vehicle theft device is a Class 3 felony.

Section 99. Effective date. This Act takes effect upon becoming law.
