SENATE RESOLUTION

 
2    RESOLVED, BY THE SENATE OF THE ONE HUNDRED FIRST GENERAL
3ASSEMBLY OF THE STATE OF ILLINOIS, that the Rules of the Senate
4of the 101st General Assembly are amended by changing Rules
53-1, 3-4, and 4-1 as follows:
 
 
6    (Senate Rule 3-1)
7    3-1. Committees.
8    (a) The committees of the Senate are: (i) the standing
9committees listed in Rule 3-4; (ii) special committees created
10by resolution or notice under Rule 3-3; and (iii) special
11subcommittees created by standing committees or by special
12committees under Rule 3-3. Subcommittees may not create
13subcommittees.
 
14    (b) All committees shall have a Chairperson and Minority
15Spokesperson, who shall not be of the same caucus, except as
16provided in Rule 3-2. Committees of the whole shall consist of
17all Senators. The number of majority caucus members and
18minority caucus members of all standing committees, and all
19other committees unless otherwise ordered by the Senate in
20accordance with these Senate Rules, shall be determined by the
21President. The numbers of majority caucus and minority caucus
22members shall become final upon the President filing with the

1Secretary an appropriate notice, which shall be Journalized.
 
2    (c) The Chairperson of a committee shall have the authority
3to call the committee to order, designate which legislative
4measures that are assigned to the committee shall be taken up,
5order the roll call vote to be taken on each legislative
6measure called for a vote, preserve order and decorum during
7committee meetings, assign legislative measures to special
8subcommittees of the parent committee, jointly sign and issue
9subpoenas with the President, and implement and supervise the
10business of the committee. The Vice-Chairperson of a committee
11may preside over its meetings in the absence or at the
12direction of the Chairperson.
 
13    (d) A vacancy on a committee, or in the Chairperson or
14Minority Spokesperson position on a committee, occurs when a
15member resigns from that position or ceases to be a Senator.
16Resignations shall be made in writing to the Secretary, who
17shall promptly notify the President and Minority Leader. Absent
18concurrence by a majority of those elected, or as otherwise
19provided in Rule 3-5, no member who resigns from a committee
20shall be reappointed to that committee for the remainder of the
21term. Replacement members shall be of the same caucus as that
22of the member who resigns, and shall be appointed by the
23President or Minority Leader, depending upon the caucus of the
24resigning member. In the case of vacancies on special

1subcommittees that were created by committees, any vacancy
2shall be filled pursuant to the motion adopted to create the
3subcommittee but if the motion does not specify how a vacancy
4is filled then the parent committee shall fill the vacancy by
5motion.
 
6    (e) The Chairperson of a committee shall have the authority
7to call meetings of that committee, subject to the approval of
8the President in accordance with Rule 2-5(c)(19). Except as
9otherwise provided by these Senate Rules, committee meetings
10shall be convened in accordance with Rule 3-11.
 
11    (f) The President, in consultation with the Minority
12Leader, may establish a process by which Senators and members
13of the public may participate remotely in hearings for standing
14committees, special committees, subcommittees or special
15subcommittees, and service committees.

1    (Senate Rule 4-1)
2    4-1. Sessions of the Senate.
3    (a) The Senate shall be deemed in session whenever it
4convenes in perfunctory session, regular session, veto
5session, or special session. Members shall be entitled to per
6diem expense reimbursements only on those regular, veto, and
7special session days that they are in attendance at the Senate.
8Attendance by members is not required or recorded during
9perfunctory sessions.
 
10    (b) Regular and veto session days shall be scheduled with
11notice by the President in accordance with Rule 2-10. Special
12session days shall be scheduled in accordance with the
13Constitution and laws of Illinois.
 
14    (c) The President, at his or her discretion, may schedule
15perfunctory sessions during which the Secretary may read into
16the Senate record any legislative measure. Properly convened
17committees may meet and may consider and act upon legislative
18measures during a perfunctory session, and the Secretary may
19receive and read committee reports into the Senate record
20during a perfunctory session. Excepting any automatic referral
21provisions of these Senate Rules, no action may be taken by the
22Senate with respect to a legislative measure during a
23perfunctory session.

1    (d) The President may also schedule perfunctory sessions
2for the purpose of affording those members designated by the
3President and Minority Leader an opportunity to negotiate with
4respect to any unfinished business of the Senate without
5necessitating the presence of all members and the related costs
6to Illinois taxpayers.
 
7    (e) In times of pestilence or public danger, the Senate may
8adopt a motion to allow a member to remotely participate and
9vote in the regular and special sessions of the Senate,
10provided that at all times a quorum of members is physically
11present at the location of session.
