SYNOPSIS AS INTRODUCED:
 
410 ILCS 35/18

    Amends the Equitable Restrooms Act. Provides that the amendatory Act may be referred to as Sami's Law. Requires every public building with restrooms open and accessible to the public to have an adult changing station for persons with disabilities.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be referred to as
5Sami's Law.
 
6    Section 5. The Equitable Restrooms Act is amended by
7changing Section 18 as follows:
 
8    (410 ILCS 35/18)
9    Sec. 18. Baby changing stations; adult changing stations
10for persons with disabilities.
11    (a) As used in this Section:
12    "Public building" means:
13        (1) a place of public accommodation, as that term is
14    defined in Section 10;
15        (2) a State building open to the public;
16        (3) a retail store of more than 5,000 square feet that
17    contains a restroom open to the public; or
18        (4) a restaurant that meets the following criteria: (A)
19    the restaurant has an occupancy of at least 60 persons, as
20    determined by the local fire department, fire protection
21    district, building permitting entity, or building
22    inspector; (B) the restaurant contains a restroom that is

1    open to the public; and (C) the restaurant's entrance is
2    not within 300 feet of a centrally located facility with a
3    baby diaper changing station and adult changing station for
4    persons with disabilities that is open to the public.
5    "Restaurant" means a business having sales of ready-to-eat
6food for immediate consumption comprising at least 51% of the
7total sales, excluding the sale of liquor.
8    (b) Every public building with restrooms open and
9accessible to the public shall have:
10        (1) at least one safe, sanitary, convenient, and
11    publicly accessible baby diaper changing station and adult
12    changing station for persons with disabilities that are is
13    accessible to women entering a restroom provided for use by
14    women and at least one safe, sanitary, convenient, and
15    publicly accessible baby diaper changing station and adult
16    changing station for persons with disabilities that are is
17    accessible to men entering a restroom provided for use by
18    men; or
19        (2) at least one safe, sanitary, convenient, and
20    publicly accessible baby diaper changing station and adult
21    changing station for persons with disabilities that are is
22    accessible to both men and women.
23    This requirement is in addition to any accommodations that
24may be made for individuals in accordance with any local,
25State, or federal laws regarding access for persons with
26disabilities and to existing fire, health, and safety codes or

1standards.
2    (c) Subsection (b) does not apply to the following:
3        (1) An industrial building, nightclub, or bar that does
4    not permit anyone who is under 18 years of age to enter the
5    premises.
6        (2) A restroom located in a health facility, if the
7    restroom is intended for the use of one patient or resident
8    at a time.
9        (3) A renovation, if a local building permitting entity
10    or building inspector determines that the installation of a
11    baby diaper changing station or adult changing station for
12    persons with disabilities is not feasible or would result
13    in a failure to comply with applicable building standards
14    governing the right of access for persons with
15    disabilities. The permitting entity or building inspector
16    may grant an exemption from the requirements of this
17    subsection under those circumstances.
18    (d) A public restroom that is open and accessible to the
19public and includes a baby diaper changing station and adult
20changing station for persons with disabilities shall include
21signage at or near the entrance to the baby changing station
22and adult changing station for persons with disabilities
23indicating the location of the baby diaper changing station and
24adult changing station for persons with disabilities.
25    (e) This Section shall not be enforceable by a private
26right of action.
