SYNOPSIS AS INTRODUCED:
 
235 ILCS 5/4-1  from Ch. 43, par. 110

    Amends the Liquor Control Act of 1934. Provides that no general ordinances or resolutions enacted pertaining to licensing, or otherwise enacted to provide for licensing for the sale at retail of alcoholic liquor, shall apply to the facilities and property of the Illinois State Fairgrounds or the DuQuoin State Fairgrounds. Effective immediately.

1    AN ACT concerning liquor.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Liquor Control Act of 1934 is amended by
5changing Section 4-1 as follows:
 
6    (235 ILCS 5/4-1)  (from Ch. 43, par. 110)
7    Sec. 4-1. Except as otherwise provided in this Section, in
8In every city, village or incorporated town, the city council
9or president and board of trustees, and in counties in respect
10of territory outside the limits of any such city, village or
11incorporated town the county board shall have the power by
12general ordinance or resolution to determine the number, kind
13and classification of licenses, for sale at retail of alcoholic
14liquor not inconsistent with this Act and the amount of the
15local licensee fees to be paid for the various kinds of
16licenses to be issued in their political subdivision, except
17those issued to the specific non-beverage users exempt from
18payment of license fees under Section 5-3 which shall be issued
19without payment of any local license fees, and the manner of
20distribution of such fees after their collection; to regulate
21or prohibit the presence of persons under the age of 21 on the
22premises of licensed retail establishments of various kinds and
23classifications where alcoholic liquor is drawn, poured, mixed

1or otherwise served for consumption on the premises; to
2prohibit any minor from drawing, pouring, or mixing any
3alcoholic liquor as an employee of any retail licensee; and to
4prohibit any minor from at any time attending any bar and from
5drawing, pouring or mixing any alcoholic liquor in any licensed
6retail premises; and to establish such further regulations and
7restrictions upon the issuance of and operations under local
8licenses not inconsistent with law as the public good and
9convenience may require; and to provide penalties for the
10violation of regulations and restrictions, including those
11made by county boards, relative to operation under local
12licenses; provided, however, that in the exercise of any of the
13powers granted in this section, the issuance of such licenses
14shall not be prohibited except for reasons specifically
15enumerated in Sections 6-2, 6-11, 6-12 and 6-25 of this Act.
16    No general ordinances or resolutions enacted under this
17Section pertaining to licensing or otherwise enacted to provide
18for licensing for the sale at retail of alcoholic liquor shall
19apply to the facilities and property of the Illinois State
20Fairgrounds or the DuQuoin State Fairgrounds.
21    However, in any municipality with a population exceeding
221,000,000 that has adopted the form of government authorized
23under "An Act concerning cities, villages, and incorporated
24towns, and to repeal certain Acts herein named", approved
25August 15, 1941, as amended, no person shall be granted any
26license or privilege to sell alcoholic liquors between the

1hours of two o'clock a.m. and seven o'clock a.m. on week days
2unless such person has given at least 14 days prior written
3notice to the alderman of the ward in which such person's
4licensed premises are located stating his intention to make
5application for such license or privilege and unless evidence
6confirming service of such written notice is included in such
7application. Any license or privilege granted in violation of
8this paragraph shall be null and void.

10    Section 99. Effective date. This Act takes effect upon
11becoming law.
