SYNOPSIS AS INTRODUCED:

65 ILCS 5/3.1-55-30 new

Amends the Illinois Municipal Code. Provides that expenses used from an expense account of a municipal officer or an individual who reports directly to the municipal officer shall be submitted to and retained by the municipality. Provides that the documentation is subject to any audit performed on municipal finances and is subject to disclosure under the Freedom of Information Act in the same manner as documentation of other expenses of the municipality. Limits home rule powers.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Municipal Code is amended by adding Section 3.1-55-30 as follows:

Sec. 3.1-55-30. Expense accounts of municipal officers. Notwithstanding any other provision of law, all documentation relating to expenses used from an expense account of a municipal officer or an individual who reports directly to the municipal officer shall be submitted to and retained by the municipality. The documentation is subject to any audit performed on municipal finances and is subject to disclosure under the Freedom of Information Act in the same manner as documentation of other expenses of the municipality.

A home rule municipality may not regulate expense accounts in a manner inconsistent with this Section. This Section is a limitation under subsection (i) of Section 6 of Article VII of the Illinois Constitution on the concurrent exercise by home rule units of powers and functions exercised by the State.
