SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/3.1-35-103 new

    Amends the Illinois Municipal Code. Provides that a comptroller or a person designated to sign the comptroller's signature shall not also be paid by the municipality or shall not be employed by a business that is paid by the municipality to provide: (i) financial advice to the municipality; or (ii) deposit, redeposit, investment, reinvestment, or withdrawal services or any other similar services for the municipality. Limits home rule powers.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by adding
5Section 3.1-35-103 as follows:
 
6    (65 ILCS 5/3.1-35-103 new)
7    Sec. 3.1-35-103. Comptroller; other employment. A
8comptroller, including a person elected or appointed under
9Section 3.1-35-100 or Section 3.1-35-115, or a person designed
10to sign the comptroller's signature under Section 3.1-35-105,
11shall not also be paid by the municipality or shall not be
12employed by a business that is paid by the municipality to
13provide: (i) financial advice to the municipality; or (ii)
14services under subsection (c) of Section 3.1-35-50 or any other
15similar services for the municipality. Item (i) shall not
16include any advice that may be required by a comptroller in the
17ordinary performance of the duties of the comptroller.
18    A home rule municipality may not regulate other employment
19of a comptroller in a manner inconsistent with this Section.
20This Section is a limitation under subsection (i) of Section 6
21of Article VII of the Illinois Constitution on the concurrent
22exercise by home rule units of powers and functions exercised
23by the State.
