SYNOPSIS AS INTRODUCED:

New Act
30 ILCS 105/5.891 new

Creates the Bill Backlog Payment Act. Provides that the proceeds from any tax or fee that (i) is enacted on or after the effective date of the Act and (ii) did not exist in this State prior to the effective date of the Act shall be deposited into the Bill Backlog Payment Fund. Provides that moneys in the Fund shall be used to pay pending vouchers approved for payment by the Office of the Comptroller that are more than 90-days past due as of the last day of each fiscal year. Provides for transfers of excess funds from the Bill Backlog Payment Fund to the General Revenue Fund. Amends the State Finance Act to create the Fund.

AN ACT concerning revenue.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Bill Backlog Payment Act.

Section 5. New tax or fee.

Notwithstanding any other provision of law, the proceeds from any tax or fee that (i) is enacted on or after the effective date of this Act and (ii) did not exist in this State prior to the effective date of this Act shall be deposited into the Bill Backlog Payment Fund, a special fund created in the State treasury. Moneys in the Bill Backlog Payment Fund shall be used to pay pending vouchers approved for payment by the Office of the Comptroller that are more than 90-days past due as of the last day of each fiscal year. If, at the end of the lapse period for each fiscal year, the balance remaining in the Bill Backlog Payment Fund exceeds the amount required for payment of those past-due vouchers, the excess balance shall be transferred from the Bill Backlog Payment Fund to the General Revenue Fund.

Section 900. The State Finance Act is amended by adding Section 5.891 as follows:
