SYNOPSIS AS INTRODUCED:
 
ILCON Art. XI, Sec. 3 new

    Proposes to amend the Environment Article of the Illinois Constitution. Provides that each person has the right to hunt, fish, and harvest wildlife, including using traditional methods, subject only to laws enacted by the General Assembly and rules adopted under authority granted by the General Assembly to: (1) promote wildlife conservation and management; and (2) preserve the future of hunting and fishing. Provides that public hunting and fishing shall be a preferred means to manage and control wildlife. Provides that nothing shall be construed to modify any provision of law that relates to trespass, property rights, or eminent domain. Effective upon being declared adopted.

CONSTITUTIONAL AMENDMENT

 
3    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
4HUNDRED FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
5SENATE CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to add Section 3 to Article XI of
9the Illinois Constitution as follows:

ENVIRONMENT

12    (ILCON Art. XI, Sec. 3 new)
13SECTION 3. HUNT, FISH, AND HARVEST
14    (a) The right of the people to hunt, fish, and harvest
15wildlife is a valued part of the State's heritage and shall be
16preserved for the public good. Each person has the right to
17hunt, fish, and harvest wildlife, including using traditional
18methods, subject only to laws enacted by the General Assembly
19and rules adopted under authority granted by the General
20Assembly to: (1) promote wildlife conservation and management;
21and (2) preserve the future of hunting and fishing. Public
22hunting and fishing shall be a preferred means to manage and
23control wildlife.

1    (b) Nothing in this Section shall be construed to modify
2any provision of law that relates to trespass, property rights,

SCHEDULE
5    This Constitutional Amendment takes effect upon being
6declared adopted in accordance with Section 7 of the Illinois
7Constitutional Amendment Act.
