| 1 | | HOUSE JOINT RESOLUTION
| 2 | | WHEREAS, As part of a recent policy trend, certain cities | 3 | | and states within the United States enacted procedures designed | 4 | | to limit cooperation with or involvement in federal immigration | 5 | | enforcement actions; and
| 6 | | WHEREAS, In January of 2020, the Illinois Department of | 7 | | Corrections (DOC) changed its policy and stopped notifying U.S. | 8 | | Immigration and Customs Enforcement (ICE) of the release of | 9 | | individuals from the DOC who had valid detainer warrants; and
| 10 | | WHEREAS, Prior to this policy change, ICE worked with the | 11 | | IDOC and local law enforcement agencies to prevent those | 12 | | convicted felons who migrated into the State illegally after | 13 | | being released into the community upon completion of their | 14 | | sentence; and
| 15 | | WHEREAS, Those individuals, convicted of felony crimes and | 16 | | who are in the country illegally, are being released directly | 17 | | into the community with no notification to federal authorities | 18 | | or local law enforcement; such actions jeopardize the general | 19 | | public safety within specific Illinois communities; and
| 20 | | WHEREAS, Such individuals have been convicted of felony | 21 | | offenses, including murder, rape, sex offenses, child |

| 1 | | pornography, and weapons offenses; and
| 2 | | WHEREAS, The policy was changed by the Illinois Department | 3 | | of Corrections without adequate notice and without sufficient | 4 | | explanation to the immigration authorities and local law | 5 | | enforcement agencies, which had previously worked valiantly | 6 | | with the immigration authorities to keep our communities safe; | 7 | | and
| 8 | | WHEREAS, Continued reduction of such regulations may yield | 9 | | to further desecration of public safety within the State of | 10 | | Illinois; therefore, be it
| 11 | | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE | 12 | | HUNDRED FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE | 13 | | SENATE CONCURRING HEREIN, that we urge Governor JB Pritzker to | 14 | | instruct the Illinois Department of Corrections to comply with | 15 | | federal law and allow the DOC to continue to work with ICE and | 16 | | local law enforcement agencies; and be it further
| 17 | | RESOLVED, That suitable copies of this resolution be | 18 | | presented to the Governor, the Speaker of the Illinois House, | 19 | | the President of the Illinois Senate, the Illinois Senate | 20 | | Minority Leader, and the Illinois House Minority Leader.
