SYNOPSIS AS INTRODUCED:

510 ILCS 70/6.5 new

Amends the Humane Care for Animals Act. Provides that no person may knowingly allow an animal to ingest cannabis, including second-hand smoke, or cannabis-infused products in a way that results in the animal's sickness or death. Provides that a first violation is a Class A misdemeanor, and a second or subsequent violation is a Class 4 felony. Effective immediately.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Humane Care for Animals Act is amended by adding Section 6.5 as follows:

(510 ILCS 70/6.5 new)

Sec. 6.5. Animal ingestion of cannabis or cannabis-infused product.

(a) As used in this Section, "cannabis" and "cannabis-infused product" have the meanings given to those terms in the Cannabis Regulation and Tax Act.

(b) No person may knowingly allow an animal to ingest cannabis, including second-hand smoke, or cannabis-infused products in a way that results in the animal's sickness or death.

(c) A person convicted of violating this Section is guilty of a Class A misdemeanor. A second or subsequent violation is a Class 4 felony.

Section 99. Effective date. This Act takes effect upon becoming law.
