SYNOPSIS AS INTRODUCED:
 
New Act
815 ILCS 505/2Z  from Ch. 121 1/2, par. 262Z

    Creates the Emergency Solutions Grant Program Act. Provides that no landlord, mortgage company, rental property owner, or other vendor shall charge an administrative or processing fee on any application for housing submitted by an applicant for assistance provided under the Emergency Solutions Grant Program (formerly the Emergency Shelter Grant Program) established under the federal Homeless Emergency Assistance and Rapid Transition to Housing (HEARTH) Act. Provides that a violation of the Act constitutes an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. Makes a conforming change in the Consumer Fraud and Deceptive Business Practices Act. Effective immediately.

1    AN ACT concerning housing.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Emergency Solutions Grant Program Act.
 
6    Section 5. Prohibited housing application fee. No
7landlord, mortgage company, rental property owner, or other
8vendor shall charge an administrative or processing fee on any
9application for housing submitted by an applicant for
10assistance provided under the Emergency Solutions Grant
11Program (formerly the Emergency Shelter Grant Program)
12established under the federal Homeless Emergency Assistance
13and Rapid Transition to Housing (HEARTH) Act. Violation of this
14Act constitutes an unlawful practice under the Consumer Fraud
15and Deceptive Business Practices Act.
 
16    Section 10. The Consumer Fraud and Deceptive Business
17Practices Act is amended by changing Section 2Z as follows:
 
18    (815 ILCS 505/2Z)  (from Ch. 121 1/2, par. 262Z)
19    Sec. 2Z. Violations of other Acts. Any person who knowingly
20violates the Automotive Repair Act, the Automotive Collision
21Repair Act, the Home Repair and Remodeling Act, the Dance

2Instrument Consumer Protection Act, the Illinois Union Label

6Organizations Act, the Automatic Telephone Dialers Act, the
7Pay-Per-Call Services Consumer Protection Act, the Telephone

9the Cemetery Oversight Act, the Cemetery Care Act, the Safe and
10Hygienic Bed Act, the Illinois Pre-Need Cemetery Sales Act, the
11High Risk Home Loan Act, the Payday Loan Reform Act, the
12Mortgage Rescue Fraud Act, subsection (a) or (b) of Section
133-10 of the Cigarette Tax Act, subsection (a) or (b) of Section
143-10 of the Cigarette Use Tax Act, the Electronic Mail Act, the
15Internet Caller Identification Act, paragraph (6) of
16subsection (k) of Section 6-305 of the Illinois Vehicle Code,
17Section 11-1431, 18d-115, 18d-120, 18d-125, 18d-135, 18d-150,
18or 18d-153 of the Illinois Vehicle Code, Article 3 of the
19Residential Real Property Disclosure Act, the Automatic
20Contract Renewal Act, the Reverse Mortgage Act, Section 25 of
21the Youth Mental Health Protection Act, the Personal
22Information Protection Act, the Emergency Solutions Grant
23Program Act, or the Student Online Personal Protection Act
24commits an unlawful practice within the meaning of this Act.
