SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Construction Apprenticeship Program Act. Provides that, as a condition of engaging in a construction business in this State, a contractor must document proof of participation in an apprenticeship program approved by and registered with the United States Department of Labor's Bureau of Apprenticeship and Training. Imposes a penalty not to exceed $5,000 for a first violation and a penalty not to exceed $10,000 for subsequent violations. Provides for enforcement by the Department of Labor and authorizes the adoption of any rules necessary to implement the Act.

1    AN ACT concerning employment.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Construction Apprenticeship Program Act.
 
6    Section 5. Definitions. In this Act:
7    "Apprentice" means a participant in an apprenticeship
8program approved by and registered with the United States
9Department of Labor's Bureau of Apprenticeship and Training.
10    "Apprenticeship program" means an apprenticeship and
11training program approved by and registered with the United
12States Department of Labor's Bureau of Apprenticeship and
13Training.
14    "Construction" means any constructing, altering,
15reconstructing, repairing, rehabilitating, refinishing,
16refurbishing, remodeling, remediating, renovating, custom
17fabricating, maintenance, landscaping, improving, wrecking,
18painting, decorating, demolishing, and adding to or
19subtracting from any building, structure, highway, roadway,
20street, bridge, alley, sewer, ditch, sewage disposal plant,
21water works, parking facility, railroad, excavation or other
22structure, project, development, real property, or
23improvement, or to do any part thereof, whether or not the

1performance of the work herein described involves the addition
2to, or fabrication into, any structure, project, development,
3real property, or improvement herein described of any material
4or article of merchandise. Construction also includes moving
5construction related materials on the job site to or from the
6job site.
7    "Contractor" means any individual, sole proprietor,
8partnership, firm, corporation, limited liability company,
9association or other legal entity permitted by law to do
10business within the State of Illinois that engages in
11construction as defined in this Act.
12    "Department" means the Illinois Department of Labor.
 
13    Section 10. Apprenticeship program participation
14mandatory. As a condition of transacting business in this
15State, a contractor must document proof of participation in an
16apprenticeship program.
 
17    Section 15. Enforcement.
18    (a) It is the duty of the Department to conduct
19investigations related to any violations of this Act, institute
20the actions for penalties provided under this Act, and to
21enforce generally the provisions of this Act.
22    (b) A contractor found to be in violation of this Act is
23subject to a civil penalty in an amount not exceeding $5,000
24for a first violation and a penalty in an amount not exceeding

1$10,000 for each subsequent violation.
2    (c) In the enforcement of this Act, the Department has the
3powers granted to it under the Illinois Wage Payment and
4Collection Act.
 
5    Section 20. Rules. The Department may adopt any rules
6necessary to implement this Act.
