SYNOPSIS AS INTRODUCED:

735 ILCS 5/2-108

from Ch. 110, par. 2-108

Amends the Code of Civil Procedure. Provides that all actions shall be tried in the county in which they are commenced, unless a statute specifically requires transfer to a different county (rather than except as otherwise provided by law). Abolishes the doctrine of intrastate forum non conveniens.

AN ACT concerning civil law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Code of Civil Procedure is amended by changing Section 2-108 as follows:

(735 ILCS 5/2-108) (from Ch. 110, par. 2-108)

Sec. 2-108. Place of trial. All actions shall be tried in the county in which they are commenced, unless a statute specifically requires transfer to a different county except as otherwise provided by law.

The doctrine of intrastate forum non conveniens is abolished.
