SYNOPSIS AS INTRODUCED:
 
5 ILCS 120/2.05  from Ch. 102, par. 42.05

    Amends the Open Meetings Act. Provides that all meetings required by the Act to be open to the public shall be audio recorded by the public body, and must be maintained by the public body for at least one year after the date of the meeting for which the recording was made.

1    AN ACT concerning government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Open Meetings Act is amended by changing
5Section 2.05 as follows:
 
6    (5 ILCS 120/2.05)  (from Ch. 102, par. 42.05)
7    Sec. 2.05. Recording meetings.
8    (a) All meetings required by this Act to be open to the
9public shall be audio recorded by the public body, and must be
10maintained by the public body for at least one year after the
11date of the meeting for which the recording was made.
12    (b) Subject to the provisions of Section 8-701 of the Code
13of Civil Procedure, any person may record the proceedings at
14meetings required to be open by this Act by tape, film or other
15means. The authority holding the meeting shall prescribe
16reasonable rules to govern the right to make such recordings.
17    (c) If a witness at any meeting required to be open by this
18Act which is conducted by a commission, administrative agency
19or other tribunal, refuses to testify on the grounds that he
20may not be compelled to testify if any portion of his testimony
21is to be broadcast or televised or if motion pictures are to be
22taken of him while he is testifying, the authority holding the
23meeting shall prohibit such recording during the testimony of

1the witness. Nothing in this Section shall be construed to
2extend the right to refuse to testify at any meeting not
3subject to the provisions of Section 8-701 of the Code of Civil
4Procedure.
