SYNOPSIS AS INTRODUCED:

720 ILCS 5/48-8.5 new

Amends the Criminal Code of 2012. Provides that a person who intentionally misrepresents an animal as a service animal commits a petty offense. Provides that a person commits intentional misrepresentation of an animal as a service animal when the person: (1) intentionally misrepresents an animal in his or her possession as his or her service animal; (2) was previously given a warning that it is illegal to intentionally misrepresent an animal as a service animal; and (3) knows that the animal is a not a service animal.

AN ACT concerning criminal law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Criminal Code of 2012 is amended by adding Section 48-8.5 as follows:

(720 ILCS 5/48-8.5 new)

Sec. 48-8.5. Misrepresentation of service animal.

(a) A person commits the offense of intentional misrepresentation of an animal as a service animal when:

(1) the person intentionally misrepresents an animal in his or her possession as his or her service animal, or a person with a disability's service animal whom the person is assisting by controlling, for the purpose of obtaining any of the rights or privileges set forth in State or federal law;

(2) the person was previously given a written or verbal warning regarding the fact that it is illegal to intentionally misrepresent an animal as a service animal; and

(3) the person knows that the animal is not a service animal.

(b) A person who violates this Section commits a petty offense.

(c) For purposes of this Section, "service animal" has the same meaning as in Section 48-8.
