SYNOPSIS AS INTRODUCED:
 
20 ILCS 2105/2105-405 new

    Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Requires the Department of Financial and Professional Regulation to adopt a standard marketing code of conduct for all pharmaceutical manufacturing companies that employ a person to sell or market prescription drugs or medical devices in the State. Provides that the Department shall require gift disclosures for certain health care professionals and their spouses when receiving gifts from pharmaceutical manufacturing companies or employees of pharmaceutical manufacturing companies. Allows the Department to further define a gift by adopting rules. Effective January 1, 2020.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Professional Regulation Law of
5the Civil Administrative Code of Illinois is amended by adding
6Section 2105-405 as follows:
 
7    (20 ILCS 2105/2105-405 new)
8    Sec. 2105-405. Code of conduct for pharmaceutical
9manufacturing companies.
10    (a) As used in this Section, "gift" means any gratuity,
11discount, entertainment, hospitality, loan, forbearance, or
12other tangible or intangible item having monetary value,
13including, but not limited to, cash, food, and drink.
14    (b) Notwithstanding any other provisions of law, the
15Department shall adopt a standard marketing code of conduct for
16all pharmaceutical manufacturing companies that employ a
17person to sell or market prescription drugs or medical devices
18in this State.
19    (c) The Department shall require the disclosure of a gift,
20and the value of that gift as defined by rules, provided by a
21pharmaceutical manufacturing company or by any employee of a
22pharmaceutical manufacturing company to a health care
23professional licensed in Illinois to prescribe or distribute

1prescription drugs or given prescriptive authority by a
2physician licensed to practice medicine in all its branches or
3by statute. The Department shall require the disclosure of a
4gift, and the value of that gift as defined by rules, provided
5by a pharmaceutical manufacturing company or by any employee of
6a pharmaceutical manufacturing company to the spouse of such a
7health care professional.
8    (d) The Department may further define the value of a gift
9by adopting rules.
 
10    Section 99. Effective date. This Act takes effect January
