SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-36 new

    Amends the Medical Assistance Article of the Illinois Public Aid Code. Requires the Auditor General to perform a performance and financial audit of the State's managed care medical assistance program. Provides that any safety-net hospital that received grant funding in State Fiscal Year 2019 shall not be obligated to pay any assessment amount, including penalties, that is past due and payable to the Department of Healthcare and Family Services until the Auditor General determines through the required audits that the average denial rate for MCO payments to safety-net hospitals is below 10%.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5adding Section 5-36 as follows:
 
6    (305 ILCS 5/5-36 new)
7    Sec. 5-36. Performance and financial audit; managed care.
8The Auditor General shall perform a performance and financial
9audit of the State's managed care medical assistance program in
10accordance with and subject to the Illinois State Auditing Act.
11Any safety-net hospital, as defined in Section 5-5e.1 of this
12Code, that received grant funding in State Fiscal Year 2019
13shall not be obligated to pay any assessment amount, including
14penalties, that is past due and payable to the Department of
15Healthcare and Family Services until the Auditor General
16determines through the audits required under this Section that
17the average denial rate for MCO payments to safety-net
18hospitals is below 10%. As used in this Section, "MCO" has the
19meaning ascribed to that term in Section 5-30.1 of this Code.
