Creates Prohibit Animal Remains in Pet Food Act. Provides that pet food is prohibited in the State if it contains: (1) any animal remains from an animal that has been euthanized by the use of any drug injected intravenously or through a nonvascular route; or (2) any dog or cat remains, regardless of how the dog or cat was killed. Makes conforming changes to the Illinois Commercial Feed Act of 1961. Effective immediately.

| 1 | | AN ACT concerning pet food.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 1. Short title. This Act may be cited as the | 5 | | Prohibit Animal Remains in Pet Food Act. | 6 | | Section 5. Prohibitions; pet food. Pet food is prohibited | 7 | | in this State if it contains: (1) any animal remains from an | 8 | | animal that has been euthanized by the use of any drug injected | 9 | | intravenously or through a nonvascular route; or (2) any dog or | 10 | | cat remains, regardless of how the dog or cat was killed. | 11 | | Section 50. The Illinois Commercial Feed Act of 1961 is | 12 | | amended by changing Section 3 as follows:

| 14 | | Sec. 3. Definitions of words and terms. When used in this | 15 | | Act unless the context otherwise requires:
| 16 | | (a) The term "person" means any individual, partnership, | 17 | | corporation
and association.
| 18 | | (b) The term "distribute" means to offer for sale, sell, | 19 | | exchange,
give away or barter commercial feed or to supply, | 20 | | furnish or otherwise
provide commercial feed to a contract | 21 | | feeder.

| 1 | | (c) The term "distributor" means any person who | 2 | | distributes.
| 3 | | (d) The term "commercial feed" means all materials,
| 4 | | including customer formula feeds, which are
distributed for use | 5 | | as feed, or labeled with a guaranteed analysis for
use as feed, | 6 | | or for mixing in feed for birds or animals
other than man | 7 | | except:
| 8 | | (1) Whole unmixed seed or grain or physically altered | 9 | | entire
unmixed seed or grain, providing such seed or grain | 10 | | is not adulterated
within the meaning of Section 7 of this | 11 | | Act.
| 12 | | (2) Unground hay, straw, stover, silage, cobs, husks | 13 | | and hulls
when not mixed with other materials and not | 14 | | adulterated within the
meaning of Section 7 of this Act.
| 15 | | (3) Individual chemical compounds when not mixed with | 16 | | other
materials and not adulterated within the meaning of | 17 | | Section 7 of this Act.
| 18 | | (e) The term "feed ingredient" means each of the | 19 | | constituent
materials making up a commercial feed.
| 20 | | (f) The term "mineral feed" means a commercial feed | 21 | | intended to
supply primarily mineral elements or inorganic | 22 | | nutrients.
| 23 | | (g) The term "drug" means any article intended for use in | 24 | | the diagnosis,
cure, mitigation, treatment, or prevention of | 25 | | disease in animals other than
man and articles other than feed | 26 | | intended to affect the structure or any
function of the |

| 1 | | animal's body.
| 2 | | (h) The term "customer-formula feed" means commercial feed
| 3 | | which consists of a mixture of commercial
feeds and/or feed | 4 | | ingredients each batch of which mixture is mixed
according to | 5 | | the specific instructions of the final purchaser.
| 6 | | (i) The term "manufacture" means to grind, mix or blend or | 7 | | further
process a commercial feed for distribution.
| 8 | | (j) The term "brand name" means any word, name,
symbol, | 9 | | device, or any combination thereof, identifying the commercial | 10 | | feed
of a distributor or manufacturer and distinguishing it | 11 | | from that of
others.
| 12 | | (k) The term "product name" means the name of the | 13 | | commercial feed which
identifies it as to kind, class, or | 14 | | specific use.
| 15 | | (l) The term "label" means a display of written, printed or | 16 | | graphic
matter upon or affixed to the container in which a | 17 | | commercial feed is
distributed, or on the invoice or delivery | 18 | | slip with which a commercial
feed or customer-formula feed is | 19 | | distributed.
| 20 | | (m) The term "ton" means a net weight of 2000 pounds | 21 | | avoirdupois.
| 22 | | (n) The term "per cent" or "percentage" means percentage by | 23 | | weight.
| 24 | | (o) The term "official sample" means any sample of feed | 25 | | taken by the
Director or his agent and designated as "official" | 26 | | by the Director or
his agent.

| 1 | | (p) The term "contract feeder" means a person who, as an | 2 | | independent
contractor, feeds commercial feed to animals | 3 | | pursuant to a contract
whereby such commercial feed is | 4 | | supplied, furnished or otherwise
provided to such person and | 5 | | whereby such person's remuneration is
determined all or in part | 6 | | by feed consumption, mortality, profits or
amount or quality of | 7 | | product.
| 8 | | (q) The term "seed" means agricultural, grass, vegetable or | 9 | | other
seeds as determined by the Department.
| 10 | | (r) The term "grain" means corn, wheat, rye, oats, barley, | 11 | | flaxseed,
sorghum, soybeans, mixed grain, and any other food | 12 | | grains, feed grains, and
oilseeds for which standards are | 13 | | established under the United States Grain Standards Act.
| 14 | | (s) The term "pet food" means any commercial feed prepared | 15 | | and
distributed for consumption by dogs and cats that does not | 16 | | contain any animal remains from an animal that has been | 17 | | euthanized by the use of any drug injected intravenously or | 18 | | through another nonvascular route or the remains of any dog or | 19 | | cat .
| 20 | | (t) The term "specialty pet food" means any commercial feed | 21 | | prepared and
distributed for consumption by specialty pets.
| 22 | | (u) The term "specialty pet" means any animal normally | 23 | | maintained in
confinement, including but not limited to, | 24 | | gerbils, hamsters, birds, fish,
snakes, turtles, and zoo | 25 | | animals.
| 26 | | (v) The term "animal" means any living creature, domestic |

| 1 | | or wild, but
does not include man.
| 2 | | (w) The term "Department" means the Department of | 3 | | Agriculture of the
State of Illinois.
| 4 | | (x) The term "Director" means the Director of the | 5 | | Department of
Agriculture of the State of Illinois or duly | 6 | | authorized representative.
