| 1 | AMENDMENT TO SENATE BILL 2902 | ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 2902 by replacing | ||||||
| 3 | everything after the enacting clause with the following: | ||||||
| 4 | "Section 5. The North Shore Water Reclamation District Act | ||||||
| 5 | is amended by changing Sections 4 and 10 as follows: | ||||||
| 6 | (70 ILCS 2305/4) (from Ch. 42, par. 280) | ||||||
| 7 | Sec. 4. Board of trustees; powers; compensation. The | ||||||
| 8 | trustees shall constitute a board of trustees for the | ||||||
| 9 | district. The board of trustees is the corporate authority of | ||||||
| 10 | the district, and shall exercise all the powers and manage and | ||||||
| 11 | control all the affairs and property of the district. The | ||||||
| 12 | board shall elect a president and vice-president from among | ||||||
| 13 | their own number. In case of the death, resignation, absence | ||||||
| 14 | from the state, or other disability of the president, the | ||||||
| 15 | powers, duties and emoluments of the office of the president | ||||||
| 16 | shall devolve upon the vice-president, until the disability is | ||||||

| 1 | removed or until a successor to the president is appointed and | ||||||
| 2 | chosen in the manner provided in this Act. The board may select | ||||||
| 3 | a secretary, treasurer, executive director, and attorney, and | ||||||
| 4 | may provide by ordinance for the employment of other employees | ||||||
| 5 | as the board may deem necessary for the municipality. The | ||||||
| 6 | board may appoint such other officers and hire such employees | ||||||
| 7 | to manage and control the operations of the district as it | ||||||
| 8 | deems necessary; provided, however, that the board shall not | ||||||
| 9 | employ an individual as a wastewater operator whose | ||||||
| 10 | Certificate of Technical Competency is suspended or revoked | ||||||
| 11 | under rules adopted by the Pollution Control Board under item | ||||||
| 12 | (4) of subsection (a) of Section 13 of the Environmental | ||||||
| 13 | Protection Act. All employees selected by the board shall hold | ||||||
| 14 | their respective offices during the pleasure of the board, and | ||||||
| 15 | give such bond as may be required by the board. The board may | ||||||
| 16 | prescribe the duties and fix the compensation of all the | ||||||
| 17 | officers and employees of the sanitary district. Except as | ||||||
| 18 | otherwise provided in this Section However, the president of | ||||||
| 19 | the board shall not receive more than $18,000 per year, and | ||||||
| 20 | each other member of the board shall not receive more than | ||||||
| 21 | $15,000 per year. Upon a unanimous vote, the board of trustees | ||||||
| 22 | may elect to raise compensation to $18,750 per year for board | ||||||
| 23 | members and $21,750 per year for the president of the board. | ||||||
| 24 | The board of trustees has full power to pass all necessary | ||||||
| 25 | ordinances, rules, and regulations for the proper management | ||||||
| 26 | and conduct of the business of the board and of the | ||||||
| |||||||
| |||||||
| 1 | corporation, and for carrying into effect the objects for | ||||||
| 2 | which the sanitary district was formed. The ordinances may | ||||||
| 3 | provide for a fine for each offense of not less than $100 or | ||||||
| 4 | more than $1,000. Each day's continuance of a violation shall | ||||||
| 5 | be a separate offense. Fines under this Section are | ||||||
| 6 | recoverable by the sanitary district in a civil action. The | ||||||
| 7 | sanitary district is authorized to apply to the circuit court | ||||||
| 8 | for injunctive relief or mandamus when, in the opinion of the | ||||||
| 9 | chief administrative officer, the relief is necessary to | ||||||
| 10 | protect the sewerage system of the sanitary district. | ||||||
| 11 | The board of trustees shall have the authority to change | ||||||
| 12 | the name of the District, by ordinance, to the North Shore | ||||||
| 13 | Water Reclamation District. Any such name change shall not | ||||||
| 14 | impair the legal status of any act by the sanitary district. If | ||||||
| 15 | an ordinance is passed pursuant to this paragraph, all | ||||||
| 16 | provisions of this Act shall apply to the newly renamed | ||||||
| 17 | district. No rights, duties, or privilege of such sanitary | ||||||
| 18 | district or of any person existing before the change of name | ||||||
| 19 | shall be affected by the change in the name of the sanitary | ||||||
| 20 | district. All proceedings pending in any court relating to | ||||||
| 21 | such sanitary district may continue to final consummation | ||||||
| 22 | under the name in which they were commenced. | ||||||

| 25 | Sec. 10. At the time or before incurring any indebtedness, | ||||||

| 1 | the board of trustees shall provide for the collection of | ||||||
| 2 | revenue a direct annual tax sufficient to pay the interest on | ||||||
| 3 | such debt as it falls due, and also to pay and discharge the | ||||||
| 4 | principal thereof as the same shall fall due, and at least | ||||||
| 5 | within 40 twenty years from the time of contracting the same. | ||||||
