| 1 | AMENDMENT TO SENATE BILL 3340 | ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 3340 on page 8, by | ||||||
| 3 | replacing lines 6 through 25 with the following: | ||||||
| 4 | "(e) Lodging customer identification. Protective medical | ||||||
| 5 | equipment shall be briefly removed by the medical device | ||||||
| 6 | wearer upon request by an operator of an inn, motel, or other | ||||||
| 7 | place of lodging to verify identification upon check-in. | ||||||
| 8 | (f) Reasonable confirmation of identity. For applicable | ||||||
| 9 | situations under subsections (c), (d), and (e), a person | ||||||
| 10 | wearing protective medical equipment may continue to do so if | ||||||
| 11 | clear window masks or other forms of protective medical | ||||||
| 12 | equipment allow an operator to reasonably confirm the | ||||||
| 13 | individual's facial features without removal of the protective | ||||||
| 14 | medical equipment. | ||||||
| 15 | (1) Determination of whether identity can be | ||||||
| 16 | reasonably confirmed shall be at the discretion of the | ||||||
| 17 | operator, consistent with State and federal law. | ||||||
| 18 | (2) If the operator cannot reasonably confirm the | ||||||

| 1 | individual's identity while the protective equipment | ||||||
| 2 | remains in place, the operator may request that the | ||||||
| 3 | individual briefly remove the equipment solely for the | ||||||
| 4 | purpose of visual identification. | ||||||
| 5 | (3) An operator shall not be liable for refusing to | ||||||
| 6 | sell, provide, or deliver any product, service, guest | ||||||
| 7 | accommodation, or room if: | ||||||
| 8 | (A) verification of identity or age is required by | ||||||
| 9 | State or federal law; or | ||||||
| 10 | (B) the operator, in good faith, determines that | ||||||
| 11 | identity cannot be reasonably confirmed while the | ||||||
| 12 | protective medical equipment remains in place, and the | ||||||
| 13 | individual refuses to comply with a reasonable request | ||||||
| 14 | to briefly remove protective medical equipment for | ||||||
| 15 | visual identification. | ||||||
| 16 | (4) Nothing in this Act shall be construed to require | ||||||
| 17 | an operator to complete a sale, furnish a service, or | ||||||
| 18 | provide access to guest accommodations to any individual | ||||||
| 19 | who declines to comply with such a reasonable request."; | ||||||
| 20 | and | ||||||
| 21 | on page 8, line 26, by replacing "(f)" with "(g)". | ||||||
