AMENDMENT TO HOUSE BILL 3193

2    AMENDMENT NO. ______. Amend House Bill 3193, AS AMENDED,
3with reference to page and line numbers of Senate Amendment
4No. 2, on page 20, by replacing lines 7 through 23 with the
5following:
 
6    "(40 ILCS 5/1-107)  (from Ch. 108 1/2, par. 1-107)
7    Sec. 1-107. Indemnification of trustees, consultants, and
8employees of retirement systems and pension funds. Every
9retirement system, pension fund, or other system or fund
10established under this Code shall may indemnify and protect
11the trustees and , staff and consultants against all damage
12claims and suits, including the defense thereof, when damages
13are sought for negligent or wrongful acts alleged to have been
14committed in the scope of employment or under the direction of
15the trustees. Every retirement system, pension fund, or other
16system or fund established under this Code may indemnify and
17protect its consultants against all damage claims and suits,

1including the defense thereof, when damages are sought for
2negligent or wrongful acts alleged to have been committed in
3the scope of employment or under the direction of the
4trustees. However, the trustees, staff, and consultants shall
5not be indemnified for willful wilful misconduct and gross
6negligence. Each board is authorized to insure against loss or
7liability of the trustees, staff and consultants which may
8result from these damage claims. This insurance shall be
9carried in a company which is licensed to write such coverage
10in this State.
