AMENDMENT TO SENATE BILL 2303

2    AMENDMENT NO. ______. Amend Senate Bill 2303 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Fire Sprinkler Contractor Licensing Act is
5amended by changing Section 62 as follows:
 
6    (225 ILCS 317/62)
7    Sec. 62. Unlicensed practice; violation; civil penalty.
8    (a) Any person, entity, or business that offers fire
9sprinkler contractor services under this Act without being
10licensed or exempt under this Act shall, in addition to any
11other penalty provided by law, pay a civil penalty, which
12shall be deposited into the Fire Prevention Fund, in an amount
13not to exceed $10,000 for each offense, as determined by the
14Office. If any person, entity, or business commits a second
15offense within 24 months, the civil penalty shall be no less
16than $10,000, which shall be deposited into the Fire

1Prevention Fund. If any person, entity, or business commits
2more than 2 offenses within 24 months, the civil penalty shall
3be no less than $25,000, which shall be deposited into the Fire
4Prevention Fund. The civil penalty shall be assessed by the
5Office after a hearing is held in accordance with the
6provisions of this Act regarding the provision of a hearing
7for the discipline of a licensee.
8    (b) Use of the title "fire sprinkler inspector" is limited
9to those individuals licensed under this Act. Any person who
10practices, offers to practice, attempts to practice, or holds
11himself or herself out to practice as a fire sprinkler
12inspector without being licensed or exempt under this Act
13shall, in addition to any other penalty provided by law, pay a
14civil penalty, which shall be deposited into the Fire
15Prevention Fund, in an amount not to exceed $10,000 for each
16offense, as determined by the Office. If any person commits a
17second offense within 24 months, the civil penalty shall be no
18less than $10,000, which shall be deposited into the Fire
19Prevention Fund. If any person commits more than 2 offenses
20within 24 months, the civil penalty shall be no less than
21$25,000, which shall be deposited into the Fire Prevention
22Fund. The civil penalty shall be assessed by the Office after a
23hearing is held in accordance with the provisions of this Act
24regarding the provision of a hearing for the discipline of a
25licensee.
26    (c) The Office may investigate any actual, alleged, or

1suspected unlicensed activity.
2    (d) The civil penalty shall be paid within 60 days after
3the effective date of the order imposing the civil penalty.
4The order shall constitute a final judgment and may be filed
5and execution had thereon in the same manner as any judgment
6from any court of record.

8    Section 99. Effective date. This Act takes effect upon
9becoming law.".
