| 2 | | AMENDMENT NO. ______. Amend Senate Bill 2303 by replacing |
| 3 | | everything after the enacting clause with the following: |
| 4 | | "Section 5. The Fire Sprinkler Contractor Licensing Act is |
| 5 | | amended by changing Section 62 as follows: |
| 6 | | (225 ILCS 317/62) |
| 7 | | Sec. 62. Unlicensed practice; violation; civil penalty. |
| 8 | | (a) Any person, entity, or business that offers fire |
| 9 | | sprinkler contractor services under this Act without being |
| 10 | | licensed or exempt under this Act shall, in addition to any |
| 11 | | other penalty provided by law, pay a civil penalty, which |
| 12 | | shall be deposited into the Fire Prevention Fund, in an amount |
| 13 | | not to exceed $10,000 for each offense, as determined by the |
| 14 | | Office. If any person, entity, or business commits a second |
| 15 | | offense within 24 months, the civil penalty shall be no less |
| 16 | | than $10,000, which shall be deposited into the Fire |

| 1 | | Prevention Fund. If any person, entity, or business commits |
| 2 | | more than 2 offenses within 24 months, the civil penalty shall |
| 3 | | be no less than $25,000, which shall be deposited into the Fire |
| 4 | | Prevention Fund. The civil penalty shall be assessed by the |
| 5 | | Office after a hearing is held in accordance with the |
| 6 | | provisions of this Act regarding the provision of a hearing |
| 7 | | for the discipline of a licensee. |
| 8 | | (b) Use of the title "fire sprinkler inspector" is limited |
| 9 | | to those individuals licensed under this Act. Any person who |
| 10 | | practices, offers to practice, attempts to practice, or holds |
| 11 | | himself or herself out to practice as a fire sprinkler |
| 12 | | inspector without being licensed or exempt under this Act |
| 13 | | shall, in addition to any other penalty provided by law, pay a |
| 14 | | civil penalty, which shall be deposited into the Fire |
| 15 | | Prevention Fund, in an amount not to exceed $10,000 for each |
| 16 | | offense, as determined by the Office. If any person commits a |
| 17 | | second offense within 24 months, the civil penalty shall be no |
| 18 | | less than $10,000, which shall be deposited into the Fire |
| 19 | | Prevention Fund. If any person commits more than 2 offenses |
| 20 | | within 24 months, the civil penalty shall be no less than |
| 21 | | $25,000, which shall be deposited into the Fire Prevention |
| 22 | | Fund. The civil penalty shall be assessed by the Office after a |
| 23 | | hearing is held in accordance with the provisions of this Act |
| 24 | | regarding the provision of a hearing for the discipline of a |
| 25 | | licensee. |
| 26 | | (c) The Office may investigate any actual, alleged, or |

| 1 | | suspected unlicensed activity. |
| 2 | | (d) The civil penalty shall be paid within 60 days after |
| 3 | | the effective date of the order imposing the civil penalty. |
| 4 | | The order shall constitute a final judgment and may be filed |
| 5 | | and execution had thereon in the same manner as any judgment |
| 6 | | from any court of record. |

| 8 | | Section 99. Effective date. This Act takes effect upon |
| 9 | | becoming law.". |
