AMENDMENT TO HOUSE BILL 2380

2    AMENDMENT NO. ______. Amend House Bill 2380, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Electric Vehicle Rebate Act is amended by
6changing Sections 10, 15, 27, and 40 as follows:
 
7    (415 ILCS 120/10)
8    Sec. 10. Definitions. As used in this Act:
9    "Agency" means the Environmental Protection Agency.
10    "Covered Area" means the counties of Cook, DuPage, Kane,
11Lake, McHenry, and Will, the townships of Aux Sable and Goose
12Lake in Grundy County, and the township of Oswego in Kendall
13County.
14    "Electric vehicle" means a vehicle that is exclusively
15powered by and refueled by electricity, must be plugged in to
16charge, and is legally permitted licensed to drive on all

1public roadways, including interstate highways. "Electric
2Vehicle" does not include electric mopeds, electric
3off-highway vehicles primarily intended to be driven
4off-highway, including golf carts and electric vehicles with a
5maximum speed below 45 miles per hour, or hybrid electric
6vehicles and extended-range electric vehicles that are also
7equipped with conventional fueled propulsion or auxiliary
8engines.
9    "Eligible applicant" means persons and families whose
10income does not exceed 500% of the federal poverty line for the
11current State fiscal year and who may not be claimed as a
12dependent.
13    "Eligible vehicle" means an electric vehicle, as defined
14by this Act, with a selling price not exceeding $80,000 as
15shown on the bill of sale, that has not previously received a
16rebate under this Act. For the purposes of this Act, State and
17local taxes, license and registration fees, documentary
18service fees, and aftermarket products, including, but not
19limited to, extended warranties, service contracts, and other
20voluntary vehicle protection products, are excluded from the
21calculation of the selling price if separately itemized on the
22bill of sale.
23    "Environmental justice community" has the same meaning,
24based on existing methodologies and findings, used and as may
25be updated by the Illinois Power Agency and its Program
26Administrator of the Illinois Solar for All Program.

1    "Low-income applicants Low income" means persons and
2families whose income does not exceed 80% of the regional or
3county State median income for the current State fiscal year,
4as established by the United States Department of Housing and
5Urban Development's Illinois Income Limits by metropolitan
6area and county Health and Human Services.

9    Sec. 15. Rulemaking. The Agency shall adopt promulgate
10rules as necessary and dedicate sufficient resources to
11implement Section 27 of this Act. Such rules shall be
12consistent with applicable provisions of the Clean Air Act and
13any regulations promulgated pursuant thereto. The Secretary of
14State may adopt promulgate rules to implement Section 35 of
15this Act.

19    Sec. 27. Electric vehicle rebate.
20    (a) Beginning July 1, 2022, and continuing as long as
21funds are available, each eligible applicant person shall be
22eligible to apply for a rebate, in the amounts set forth below,
23following the purchase of an eligible electric vehicle in
24Illinois. The Agency shall accept applications and issue

1rebates consistent with the provisions of this Act and any
2implementing regulations adopted by the Agency. In no event
3shall a rebate amount exceed the purchase price of the
4vehicle.
5        (1) Beginning July 1, 2025 2022, a $2,000 $4,000
6    rebate for eligible applicants toward the purchase of a
7    new or used an electric vehicle that is not an electric
8    motorcycle and a $1,500 rebate for the purchase of an
9    electric vehicle that is an electric motorcycle.
10    Low-income applicants are eligible for an additional
11    $2,000 rebate for new or used vehicles that are not
12    electric motorcycles.
13        (2) (Blank). Beginning July 1, 2026, a $2,000 rebate
14    for the purchase of an electric vehicle that is not an
15    electric motorcycle.
16        (3) Beginning July 1, 2028, a $1,500 rebate for
17    eligible applicants toward the purchase of a new or used
18    an electric vehicle that is not an electric motorcycle and
19    a $750 rebate for the purchase of an electric vehicle that
20    is an electric motorcycle. Low-income applicants are
21    eligible for an additional $1,500 for new or used vehicles
22    that are not electric motorcycles.
23        (4) (Blank). Beginning July 1, 2022, a $1,500 rebate
24    for the purchase of an electric vehicle that is an
25    electric motorcycle.
26    (b) To be eligible to receive a rebate, a purchaser must:

1        (1) Reside in Illinois, both at the time the vehicle
2    was purchased and at the time the rebate is issued.
3        (2) Purchase an electric vehicle in Illinois on or
4    after July 1, 2022 and be the owner of the vehicle at the
5    time the rebate is issued. Rented or leased vehicles,
6    vehicles purchased from an out-of-state dealership, and
7    vehicles delivered to or received by the purchaser
8    out-of-state are not eligible for a rebate under this Act.
9        (3) Apply for the rebate within 180 90 days after the
10    vehicle purchase date, and provide to the Agency proof of
11    residence, proof of vehicle ownership, and proof that the
12    vehicle was purchased in Illinois, including a copy of a
13    purchase agreement noting an Illinois seller. The
14    purchaser must notify the Agency of any changes in
15    residency or ownership of the vehicle that occur between
16    application for a rebate and issuance of a rebate.
17        (4) Apply for the rebate during an open rebate cycle,
18    as identified by the Agency.
19        (5) Certify that the purchaser qualifies as an
20    eligible applicant and a low-income applicant, if
21    applicable.
22    (c) The Agency shall make available in application
23materials methods for purchasers to identify as low-income
24applicants. The Agency shall prioritize the review of
25qualified applications from low-income applicant purchasers
26and award rebates to qualified purchasers accordingly.

1    (d) The purchaser must retain ownership of the vehicle for
2a minimum of 12 consecutive months immediately after the
3vehicle purchase date. The purchaser must continue to reside
4in Illinois during that time frame and register the vehicle in
5Illinois during that time frame. Rebate recipients who fail to
6satisfy any of the above criteria will be required to
7reimburse the Agency all or part of the original rebate amount
8and shall notify the Agency within 60 days of failing to
9satisfy the criteria.
10    (e) Rebates administered under this Section shall be
11available for both new and used electric vehicles.
12    (f) A rebate administered under this Act may only be
13applied for and awarded one time per vehicle identification
14number. A rebate may only be applied for and awarded once per
15purchaser in any 10-year period.
16    (g) For program auditing purposes, the Agency may request
17from a rebate recipient additional information and
18documentation evidencing eligibility for a rebate issued on or
19after July 1, 2025, including copies of income tax returns
20that corroborate the certification referenced in paragraph (5)
21of subsection (b). If requested by the Agency, a rebate
22recipient shall provide the information and documentation
23within the timeframe specified in the Agency's request. If the
24rebate recipient fails to provide the information and
25documentation requested by the Agency by the specified
26deadline, or if the information and documentation provided

1evidences that the rebate recipient was not eligible for the
2rebate or the rebate recipient fails to corroborate the
3certification referenced in paragraph (5) of subsection (b),
4the rebate recipient may be required to reimburse the Agency
5all or part of the original rebate amount.

7    (415 ILCS 120/40)
8    Sec. 40. Appropriations from the Electric Vehicle Rebate
9Fund.
10    (a) The Agency shall estimate the amount of user fees
11expected to be collected under Section 35 of this Act for each
12fiscal year. User fee funds shall be deposited into and
13distributed from the Electric Vehicle Rebate Fund in the
14following manner:
15        (1) Through fiscal year 2023, an annual amount not to
16    exceed $225,000 may be appropriated to the Agency from the
17    Electric Vehicle Rebate Fund to pay its costs of
18    administering the programs authorized by Section 27 of
19    this Act. Beginning in fiscal year 2024 and in each fiscal
20    year thereafter, an annual amount not to exceed $600,000
21    may be appropriated to the Agency from the Electric
22    Vehicle Rebate Fund to pay its costs of administering the
23    programs authorized by Section 27 of this Act. An amount
24    not to exceed $225,000 may be appropriated to the
25    Secretary of State from the Electric Vehicle Rebate Fund

1    to pay the Secretary of State's costs of administering the
2    programs authorized under this Act.
3        (2) In fiscal year 2022 and each fiscal year
4    thereafter, after appropriation of the amounts authorized
5    by item (1) of subsection (a) of this Section, the
6    remaining moneys estimated to be collected during each
7    fiscal year shall be appropriated.
8        (3) (Blank).
9        (4) Moneys appropriated to fund the programs
10    authorized in Sections 25 and 30 shall be expended only
11    after they have been collected and deposited into the
12    Electric Vehicle Rebate Fund.
13    (b) Amounts General Revenue Fund amounts appropriated to
14and deposited into the Electric Vehicle Rebate Fund from the
15General Revenue Fund, or any other fund, shall be distributed
16from the Electric Vehicle Rebate Fund to fund the program
17authorized in Section 27.
