| 1 | AMENDMENT TO SENATE BILL 1954 | ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 1954 by replacing | ||||||
| 3 | everything after the enacting clause with the following: | ||||||
| 4 | "Section 5. The Counties Code is amended by adding | ||||||
| 5 | Division 3-16 as follows: | ||||||
| 6 | (55 ILCS 5/Div. 3-16 heading new) | ||||||
| 7 | Division 3-16. Recall of Countywide Elected Officials | ||||||
| 8 | (55 ILCS 5/3-16001 new) | ||||||
| 9 | Sec. 3-16001. Recall of a countywide elected official. | ||||||
| 10 | (a) Any county may establish a process by which countywide | ||||||
| 11 | elected officials may be recalled by the electors of the | ||||||
| 12 | county, by submitting the proposition to the electors of the | ||||||
| 13 | county and obtaining their approval of the proposition at a | ||||||
| 14 | referendum held at the general election of 2026 as provided in | ||||||
| 15 | Section 3-16002. A referendum to adopt a process by which | ||||||

| 1 | countywide elected officials may be recalled by the electors | ||||||
| 2 | may be called for by a resolution adopted before the general | ||||||
| 3 | election of 2026 by the county board of the county. | ||||||
| 4 | (b) As used in this Division, "countywide elected | ||||||
| 5 | official" means any elected official who is elected by the | ||||||
| 6 | entire county, but it does not include either: (i) a county | ||||||
| 7 | treasurer who is subject to removal under Section 3-10020 or | ||||||
| 8 | (ii) a regional superintendent of schools. | ||||||

| 10 | Sec. 3-16002. Referendum on resolution of county board. | ||||||
| 11 | (a) If the county board adopts a resolution calling for a | ||||||
| 12 | referendum at the general election of 2026 on the proposal to | ||||||
| 13 | adopt a process by which countywide elected officials may be | ||||||
| 14 | recalled by the electors of that county, within the time | ||||||
| 15 | provided in the general election law, the county clerk and the | ||||||
| 16 | county board shall provide for the submission of such | ||||||
| 17 | proposition to the electors of the county in accordance with | ||||||
| 18 | this Section at the general election of 2026. | ||||||
| 19 | (b) The referendum shall be conducted in such a manner as | ||||||
| 20 | is prescribed in the general election law. | ||||||
| 21 | The proposition shall be in substantially the following | ||||||
| 22 | form: | ||||||

| 5 | 3-16003 of the Counties Code? | ||||||

| 8 | Sec. 3-16003. Recall of countywide elected officials. | ||||||
| 9 | (a) If the referendum described in Section 3-16002 is | ||||||
| 10 | approved by a majority of the voters voting on the | ||||||
| 11 | proposition, then the recall of countywide elected officials | ||||||
| 12 | in that county may thereafter be proposed by a petition signed | ||||||
| 13 | by a number of electors equal in number to at least 15% of the | ||||||
| 14 | total votes cast for Governor in that county in the preceding | ||||||
| 15 | gubernatorial election. A petition under this Section shall | ||||||
| 16 | have been signed by the petitioning electors not more than 50 | ||||||
| 17 | days after an affidavit has been filed with the State Board of | ||||||
| 18 | Elections providing notice of intent to circulate a petition | ||||||
| 19 | to recall the countywide elected official. The affidavit may | ||||||
| 20 | be filed no sooner than 6 months after the beginning of the | ||||||
| 21 | countywide elected official's term of office and may not be | ||||||
| 22 | filed in the last 6 months of the countywide elected | ||||||
| 23 | official's term of office. | ||||||
| 24 | (b) The form of the petition, circulation, and procedure | ||||||
| 25 | for determining the validity and sufficiency of a petition | ||||||

| 1 | shall be as provided by law. If the petition is valid and | ||||||
| 2 | sufficient, the State Board of Elections shall certify the | ||||||
| 3 | petition not more than 50 days after the date the petition was | ||||||
| 4 | filed, and the question "Shall (name) be recalled from the | ||||||
| 5 | office of (name of office)?" must be submitted to the electors | ||||||
| 6 | at a special election called by the State Board of Elections, | ||||||
| 7 | to occur not more than 100 days after certification of the | ||||||
| 8 | petition. A recall petition certified by the State Board of | ||||||
| 9 | Elections under this Section may not be withdrawn and another | ||||||
| 10 | recall petition under this Section may not be initiated | ||||||
| 11 | against the countywide elected official during the remainder | ||||||
| 12 | of the official's current term of office. Any recall petition | ||||||
| 13 | or recall election pending on the date of the next general | ||||||
| 14 | election at which a candidate for the same countywide office | ||||||
| 15 | is elected is moot. | ||||||
| 16 | (c) The countywide elected official is immediately removed | ||||||
| 17 | upon certification of the recall election results if a | ||||||
| 18 | majority of the electors voting on the question vote to recall | ||||||
| 19 | the countywide elected official. If the countywide elected | ||||||
| 20 | official is removed, the vacancy shall be filled as provided | ||||||
| 21 | in the Election Code or this Code. | ||||||
| 22 | Section 99. Effective date. This Act takes effect upon | ||||||
| 23 | becoming law.". | ||||||
