| 2 | AMENDMENT NO. ______. Amend House Bill 2380 by replacing | ||||||
| 3 | everything after the enacting clause with the following: | ||||||
| 4 | "Section 5. The Electric Vehicle Rebate Act is amended by | ||||||
| 5 | changing Sections 10, 15, 27, and 40 as follows: | ||||||
| 6 | (415 ILCS 120/10) | ||||||
| 7 | Sec. 10. Definitions. As used in this Act: | ||||||
| 8 | "Agency" means the Environmental Protection Agency. | ||||||
| 9 | "Covered Area" means the counties of Cook, DuPage, Kane, | ||||||
| 10 | Lake, McHenry, and Will, the townships of Aux Sable and Goose | ||||||
| 11 | Lake in Grundy County, and the township of Oswego in Kendall | ||||||
| 12 | County. | ||||||
| 13 | "Electric vehicle" means a vehicle that is exclusively | ||||||
| 14 | powered by and refueled by electricity, must be plugged in to | ||||||
| 15 | charge, has a traction battery with a capacity of at least 7 | ||||||
| 16 | kilowatt hours, and is legally permitted licensed to drive on | ||||||
| |||||||
| |||||||
| 1 | all public roadways, including interstate highways. "Electric | ||||||
| 2 | Vehicle" does not include electric mopeds, electric | ||||||
| 3 | off-highway vehicles primarily intended to be driven off-road, | ||||||
| 4 | including golf carts and electric vehicles with a maximum | ||||||
| 5 | speed below 45 miles per hour, or hybrid electric vehicles and | ||||||
| 6 | extended-range electric vehicles that are also equipped with | ||||||
| 7 | conventional fueled propulsion or auxiliary engines. | ||||||
| 8 | "Eligible applicant" means persons and families whose | ||||||
| 9 | income does not exceed 400% of the federal poverty line for the | ||||||
| 10 | current State fiscal year and those who may not be claimed as a | ||||||
| 11 | dependent. The Agency may, in its discretion, adjust income | ||||||
| 12 | limits. | ||||||
| 13 | "Eligible vehicle" means an electric vehicle, as defined | ||||||
| 14 | by this Act, with a purchase price not exceeding $80,000 that | ||||||
| 15 | has not previously received a rebate under this Act. The | ||||||
| 16 | Agency may, in its discretion, adjust the maximum purchase | ||||||
| 17 | price allowable or otherwise limit eligibility to incentivize | ||||||
| 18 | a variety of makes and models and adjust for inflation. | ||||||
| 19 | "Environmental justice community" has the same meaning, | ||||||
| 20 | based on existing methodologies and findings, used and as may | ||||||
| 21 | be updated by the Illinois Power Agency and its Program | ||||||
| 22 | Administrator of the Illinois Solar for All Program. | ||||||
| 23 | "Low-income" means persons and families whose income does | ||||||
| 24 | not exceed 80% of the regional or county State median income | ||||||
| 25 | for the current State fiscal year, as established by the | ||||||
| 26 | United States Department of Housing and Urban Development's | ||||||

| 1 | Illinois Income Limits by metropolitan area and county, or | ||||||
| 2 | those who participate in or are eligible for federal or State | ||||||
| 3 | assistance programs Health and Human Services. | ||||||

| 6 | Sec. 15. Rulemaking. The Agency shall adopt promulgate | ||||||
| 7 | rules as necessary and dedicate sufficient resources to | ||||||
| 8 | implement Section 27 of this Act. Such rules shall be | ||||||
| 9 | consistent with applicable provisions of the Clean Air Act and | ||||||
| 10 | any regulations promulgated pursuant thereto. The Secretary of | ||||||
| 11 | State may adopt promulgate rules to implement Section 35 of | ||||||
| 12 | this Act. | ||||||

| 16 | Sec. 27. Electric vehicle rebate. | ||||||
| 17 | (a) Beginning July 1, 2026 2022, and continuing as long as | ||||||
| 18 | funds are available, each income-eligible person shall be | ||||||
| 19 | eligible to apply for a rebate, in the amounts set forth below, | ||||||
| 20 | following the purchase of an eligible electric vehicle in | ||||||
| 21 | Illinois. The Agency shall accept applications and issue | ||||||
| 22 | rebates consistent with the provisions of this Act and any | ||||||
| 23 | implementing regulations adopted by the Agency for the | ||||||
| 24 | duration of each fiscal year. The Agency shall establish one | ||||||
| |||||||
| |||||||
| 1 | rebate application cycle for each State fiscal year, shall | ||||||
| 2 | cause each rebate application cycle to have a duration of one | ||||||
| 3 | State fiscal year, and shall cause the Agency to accept rebate | ||||||
| 4 | applications and issue rebates under this Act throughout each | ||||||
| 5 | rebate application cycle. In no event shall a rebate amount | ||||||
| 6 | exceed the purchase price of the vehicle. | ||||||
| 7 | (1) Beginning July 1, 2026 2022, a $2,000 $4,000 | ||||||
| 8 | rebate for eligible applicants toward the purchase of a | ||||||
| 9 | new or used an electric vehicle that is not an electric | ||||||
| 10 | motorcycle and a $1,500 rebate for the purchase of an | ||||||
| 11 | electric vehicle that is an electric motorcycle. | ||||||
| 12 | Low-income applicants are eligible for an additional | ||||||
| 13 | $2,000 rebate for new vehicles or $1,500 for used vehicles | ||||||
| 14 | that are not electric motorcycles.. | ||||||
| 15 | (2) Beginning July 1, 2028 2026, a $2,000 rebate for | ||||||
| 16 | eligible applicants toward the purchase of a new or used | ||||||
| 17 | an electric vehicle that is not an electric motorcycle and | ||||||
| 18 | a $750 rebate for the purchase of an electric vehicle that | ||||||
| 19 | is an electric motorcycle. Low-income applicants are | ||||||
| 20 | eligible for an additional $1,000 for new or used vehicles | ||||||
| 21 | that are not electric motorcycles. | ||||||
| 22 | (3) (Blank) Beginning July 1, 2028, a $1,500 rebate | ||||||
| 23 | for the purchase of an electric vehicle that is not an | ||||||
| 24 | electric motorcycle. | ||||||
| 25 | (4) (Blank) Beginning July 1, 2022, a $1,500 rebate | ||||||
| 26 | for the purchase of an electric vehicle that is an | ||||||
| |||||||
| |||||||
| 1 | electric motorcycle. | ||||||
| 2 | (b) To be eligible to receive a rebate, a purchaser must: | ||||||
| 3 | (1) Reside in Illinois, both at the time the vehicle | ||||||
| 4 | was purchased and at the time the rebate is issued. | ||||||
| 5 | (2) Purchase an electric vehicle in Illinois on or | ||||||
| 6 | after July 1, 2026 2022 and be the owner of the vehicle at | ||||||
| 7 | the time the rebate is issued. Rented or leased vehicles, | ||||||
| 8 | vehicles purchased from an out-of-state dealership, and | ||||||
| 9 | vehicles delivered to or received by the purchaser | ||||||
| 10 | out-of-state are not eligible for a rebate under this Act. | ||||||
| 11 | (3) (Blank) Apply for the rebate within 90 days after | ||||||
| 12 | the vehicle purchase date, and provide to the Agency proof | ||||||
| 13 | of residence, proof of vehicle ownership, and proof that | ||||||
| 14 | the vehicle was purchased in Illinois, including a copy of | ||||||
| 15 | a purchase agreement noting an Illinois seller. The | ||||||
| 16 | purchaser must notify the Agency of any changes in | ||||||
| 17 | residency or ownership of the vehicle that occur between | ||||||
| 18 | application for a rebate and issuance of a rebate. | ||||||
| 19 | (c) Beginning July 1, 2026, the Agency or its contracted | ||||||
| 20 | administrator of the program authorized by this Section must | ||||||
| 21 | make available vouchers for applicants to receive rebates at | ||||||
| 22 | the point-of-sale from a dealer located in Illinois and | ||||||
| 23 | licensed by the Illinois Secretary of State, which shall | ||||||
| 24 | deduct the applicable rebate amount from the final negotiated | ||||||
| 25 | and agreed upon sale price of the eligible vehicle, in which | ||||||
| 26 | case the full amount of the incentive shall be passed through | ||||||
| |||||||
| |||||||
| 1 | to the purchaser in full with payment and shall be effective | ||||||
| 2 | immediately at the time of the final sale and transfer of the | ||||||
| 3 | eligible vehicle to the purchaser. Proof of applicant | ||||||
| 4 | eligibility, including proof of residence and income, are | ||||||
| 5 | required for voucher issuance. | ||||||
| 6 | (c-5) The Agency shall make available a public dashboard | ||||||
| 7 | with resources on electric vehicles, charging infrastructure, | ||||||
| 8 | applicant and vehicle eligibility, participating dealers, | ||||||
| 9 | State incentives, and as up-to-date as is feasible remaining | ||||||
| 10 | funding availability for the fiscal year. (c) The Agency shall | ||||||
| 11 | make available in application materials methods for purchasers | ||||||
| 12 | to identify as low-income. The Agency shall prioritize the | ||||||
| 13 | review of qualified applications from low-income purchasers | ||||||
| 14 | and award rebates to qualified purchasers accordingly. | ||||||
| 15 | (d) The purchaser must retain ownership of the vehicle for | ||||||
| 16 | a minimum of 12 consecutive months immediately after the | ||||||
| 17 | vehicle purchase date. The purchaser must continue to reside | ||||||
| 18 | in Illinois during that time frame and register the vehicle in | ||||||
| 19 | Illinois during that time frame. Rebate recipients who fail to | ||||||
| 20 | satisfy any of the above criteria will be required to | ||||||
| 21 | reimburse the Agency all or part of the original rebate amount | ||||||
| 22 | and shall notify the Agency within 60 days of failing to | ||||||
| 23 | satisfy the criteria. | ||||||
| 24 | (e) (Blank) Rebates administered under this Section shall | ||||||
| 25 | be available for both new and used electric vehicles. | ||||||
| 26 | (f) A rebate administered under this Act may only be | ||||||
| |||||||
| |||||||
| 1 | applied for and awarded one time per vehicle identification | ||||||
| 2 | number. A rebate may only be applied for and awarded once per | ||||||
| 3 | purchaser in any 10-year period. The changes to this Section | ||||||
| 4 | by this amendatory Act of the 104th General Assembly are not | ||||||
| 5 | intended to affect any rebates issued under this Section | ||||||
| 6 | before the effective date of this amendatory Act of the 104th | ||||||
| 7 | General Assembly. | ||||||

| 9 | (415 ILCS 120/40) | ||||||
| 10 | Sec. 40. Appropriations from the Electric Vehicle Rebate | ||||||
| 11 | Fund. | ||||||
| 12 | (a) The Agency shall estimate the amount of user fees | ||||||
| 13 | expected to be collected under Section 35 of this Act for each | ||||||
| 14 | fiscal year. User fee funds shall be deposited into and | ||||||
| 15 | distributed from the Electric Vehicle Rebate Fund in the | ||||||
| 16 | following manner: | ||||||
| 17 | (1) Through fiscal year 2023, an annual amount not to | ||||||
| 18 | exceed $225,000 may be appropriated to the Agency from the | ||||||
| 19 | Electric Vehicle Rebate Fund to pay its costs of | ||||||
| 20 | administering the programs authorized by Section 27 of | ||||||
| 21 | this Act. Beginning in fiscal year 2024 and in each fiscal | ||||||
| 22 | year thereafter, an annual amount not to exceed $600,000 | ||||||
| 23 | may be appropriated to the Agency from the Electric | ||||||
| 24 | Vehicle Rebate Fund to pay its costs of administering the | ||||||
| 25 | programs authorized by Section 27 of this Act. An amount | ||||||
| |||||||
| |||||||
| 1 | not to exceed $225,000 may be appropriated to the | ||||||
| 2 | Secretary of State from the Electric Vehicle Rebate Fund | ||||||
| 3 | to pay the Secretary of State's costs of administering the | ||||||
| 4 | programs authorized under this Act. | ||||||
| 5 | (2) In fiscal year 2022 and each fiscal year | ||||||
| 6 | thereafter, after appropriation of the amounts authorized | ||||||
| 7 | by item (1) of subsection (a) of this Section, the | ||||||
| 8 | remaining moneys estimated to be collected during each | ||||||
| 9 | fiscal year shall be appropriated. | ||||||
| 10 | (3) (Blank). | ||||||
| 11 | (4) Moneys appropriated to fund the programs | ||||||
| 12 | authorized in Sections 25 and 30 shall be expended only | ||||||
| 13 | after they have been collected and deposited into the | ||||||
| 14 | Electric Vehicle Rebate Fund. | ||||||
| 15 | (b) Amounts appropriated to and deposited into the | ||||||
| 16 | Electric Vehicle Rebate Fund from the General Revenue Fund, or | ||||||
| 17 | any other fund, General Revenue Fund amounts appropriated to | ||||||
| 18 | and deposited into the Electric Vehicle Rebate Fund shall be | ||||||
| 19 | distributed from the Electric Vehicle Rebate Fund to fund the | ||||||
| 20 | program authorized in Section 27. | ||||||
| 21 | (c) Subject to State procurement requirements, the Agency | ||||||
| 22 | may retain a contractor or contractors to assist with | ||||||
| 23 | marketing, program development, and administration of programs | ||||||
| 24 | authorized by Section 27 of this Act. | ||||||
