AMENDMENT TO HOUSE BILL 1461

AMENDMENT NO. ______. Amend House Bill 1461 by replacing everything after the enacting clause with the following:

"Section 5. Upon the payment of the sum of $1.00 to the State of Illinois, the Director of the Department of Natural Resources is authorized to convey a non-exclusive easement to the KSS Conservation Partners, LLC that is a 20 feet wide ingress-egress easement from public right of way of Banner Dike Road to Senate Island more particularly described as follows:

WIDE INGRESS/EGRESS EASEMENT FROM SENATE ISLAND

TO PUBLIC RIGHT OF WAY OF BANNER DIKE ROAD SEGMENT "A" A part of Section 2 and Section 3, Township 5 North, Range 5 East of the Fourth Principal Meridian, and a part of Section 25, Section 26, and Section 35, Township 6 North, Range 5 East of the Fourth Principal Meridian, Fulton County, Illinois, being more particularly described as follows: Commencing at the South Quarter corner of Section 5, Township 5 North, Range 5 East of the Fourth Principal Meridian; thence South 88 degrees 37 minutes 47 seconds East, along the South line of said Section 5, a distance of 2627.33 feet to the Southwest corner of Section 4, Township 5 North, Range 5 East of the Fourth Principal Meridian; thence South 89 degrees 34 minutes 34 seconds East, along the South line of the Southwest Quarter of said Section 4, a distance of 2637.75 feet to the South Quarter corner of said Section 4; thence South 89 degrees 34 minutes 46 seconds East, along the South line of the Southeast Quarter of said Section 4, a distance of 2636.24 feet to the Southeast corner of said Section 4; thence North 75 degrees 29 minutes 01 seconds East a distance of 4905.87 feet to the centerline point of beginning of the 20 foot wide ingress/egress easement to be described, said point also being a point at the property line of Senate Island as described in Warranty Deed Document Number 2305419 recorded in the Fulton County Recorder's Office, and the centerline of an existing access road. (The following courses are along an existing access road from Senate Island to the public right of way of Banner Dike Road.) SEGMENT "B" A part of Section 2, Township 5 North, Range 5 East of the Fourth Principal Meridian, Fulton County, Illinois, being more particularly described as follows: Commencing at said Point "B" as the centerline point of beginning to the 20 foot wide ingress/egress easement to be described; thence South 19 degrees 02 minutes 25 seconds East a distance of 49.69 feet; thence South 71 degrees 39 minutes 03 seconds East a distance of 118.98 feet; thence South 58 degrees 22 minutes 30 seconds East a distance of 151.33; thence South 40 degrees 30 minutes 31 seconds East a distance of 61.47 feet; thence South 38 degrees 10 minutes 39 seconds East a distance of 99.13 feet to the point of terminus being a point at the property line of Senate Island as described in Warranty Deed Document Number 2305419 recorded in the Fulton County Recorder's Office, and the centerline of the existing access road.

Section 10. The conveyance of the easement authorized by Section 5 shall be made subject to: (1) existing public utilities, existing public roads, and any and all reservations, easements, encumbrances, covenants and restrictions of record; (2) the entering into of a shared maintenance agreement for the land listed in Section 5 that is the subject of the easement between the Department of Natural Resources and KSS Conservation Partners, LLC; and (3) the express condition that if either the Department of Natural Resources or KSS Conservation Partners, LLC ceases to have a shared maintenance agreement for the land that is the subject of the easement in Section 5, said easement shall automatically terminate and the land shall fully revert to the State of Illinois, Department of Natural Resources.

Section 900. The Director of the Department of Natural Resources shall obtain a certified copy of this Act within 60 days after the Act becomes law and shall only record the Act in the Recorder's Office of Fulton County, Illinois after the Department of Natural Resources and KSS Conservation Partners, LLC have entered into a shared maintenance agreement as required in Section 10.

Section 999. Effective date. This Act takes effect upon becoming law.".
