Synopsis As Introduced Amends the Animal Welfare Act. Sets forth disclosure requirements for any dog or cat made available for adoption or sale by an animal shelter, animal control facility, or pet shop operator, including adoptions or sales available over the internet. Sets forth certain requirements concerning an acknowledgement of disclosures form which must be signed by the customer or adopter and the pet shop operator or authorized representative of the animal shelter or animal control facility. Makes other changes. Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that any person who knowingly violates the disclosure requirements for a pet shop operator who sells a dog or cat under the Animal Welfare Act commits an unlawful practice. Effective January 1, 2011.
Deletes everything after the enacting clause and reinserts the bill as introduced, with the following changes: in the Animal Welfare Act, removes certain items from the list of required disclosures; removes all provisions concerning required disclosures over the internet; provides that information regarding inoculations and medical treatment shall be updated at least once every 7 days; adds as a required disclosure the license number issued by the Illinois Department of Agriculture to the animal shelter, animal control facility, or pet store operator; makes other changes; and removes all provisions concerning the Consumer Fraud and Deceptive Business Practices Act. Effective January 1, 2011.
Senate Committee Amendment No. 1 Deletes everything after the enacting clause and reinserts the bill as engrossed, with the following changes: removes provisions that information concerning inoculation or medical treatment shall be updated at least once every 7 days; no longer requires disclosure of information concerning any known citations or fines issued to the animal shelter, animal control facility, pet shop operator, or breeder within a certain time period; no longer requires a pet shop operator to disclose the total number of puppies or kittens that were born at the breeder's facility in the prior calendar year; makes a change to the required statement in the acknowledgement of disclosures form; and provides that a copy of the policy regarding warranties, refunds, or returns shall be provided to the adopter or customer. Effective January 1, 2011.
