Synopsis As Introduced Amends the Firearm Owner Identification Card Act. Requires (instead of permits) the Department of State Police to deny an application or to revoke and seize a Firearm Owner's Identification Card previously issued under the Act if the Department finds that the applicant or person to whom such card was issued is or was at the time of issuance the subject to an existing order of protection. Amends the Domestic Violence Article of the Code of Criminal Procedure of 1963 and the Illinois Domestic Violence Act of 1986. Provides that if the court is satisfied that there is any danger of the illegal use of firearms, it shall include in the order of protection the requirement that any Firearm Owner's Identification Card of the respondent be turned over to the local law enforcement agency for safekeeping.
Provides in the provisions relating to remedies in the Domestic Violence Article of the Code of Criminal Procedure relating to the prohibition of the respondent possessing firearms, if the court is satisfied that there is any danger of the illegal use of firearms, and the respondent is present in court, it shall issue an order that the respondent's Firearms Owner's Identification Card be turned over to the local law enforcement agency for safekeeping. Provides that upon expiration of the period of safekeeping, if the firearms or Firearms Owner's Identification Card cannot be returned to respondent because respondent cannot be located, fails to respond to requests to retrieve the firearms, or is not lawfully eligible to possess a firearm, upon petition from the local law enforcement agency, the court may order the local law enforcement agency to destroy the firearms, use the firearms for training purposes, or for any other application as deemed appropriate by the local law enforcement agency; or that the firearms be turned over to a third party who is lawfully eligible to possess firearms, and who does not reside with respondent. In the amendatory changes to the Illinois Domestic Violence Act of 1986, provides that an emergency order of protection may be granted if there is good cause to prohibit the respondent from possessing firearms. Provides that the court may prohibit the respondent from entering or remaining in any household or premises of the petitioner.
