Synopsis As Introduced
Amends the Security Deposit Return Act. In a provision that requires a lessor to return a security deposit or prepaid rent to the lessee upon transfer of residential property, removes an exception for property acquired by a lienholder.

Replaces everything after the enacting clause. Amends the Code of Civil Procedure. Provides that in foreclosure proceedings involving mortgaged property with 5 or more dwelling units, the court shall order that the mortgagor transfer to the purchaser any security deposit paid by a current occupant of a dwelling unit of the mortgaged property. Amends the Security Deposit Return Act. Provides that when a lessor transfers a security deposit received from a lessee including interest to a purchaser of a foreclosed property, the purchaser is liable to the lessee for the security deposit, including interest. Provides that within 21 days after receipt of the security deposits, the purchaser shall post a notice at each dwelling unit for which the purchaser has a security deposit informing the occupant of the security deposit receipt. Makes other changes. Effective immediately.

Senate Committee Amendment No. 1
Replaces everything after the enacting clause with provisions identical to the engrossed bill except that it: provides that within 21 days after receipt of the security deposits and the names and addresses of lessees who paid a deposit (instead of within 21 days after receipt of the security deposits), the purchaser shall, at each dwelling unit for which the purchaser has a security deposit, post a notice that informs the occupant of the receipt of the occupant's security deposit. Makes other changes. Effective immediately.
