1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Electric Vehicle Rebate Act is amended by
5changing Sections 10, 15, 27, and 40 as follows:
 
6    (415 ILCS 120/10)
7    Sec. 10. Definitions. As used in this Act:
8    "Agency" means the Environmental Protection Agency.
9    "Covered Area" means the counties of Cook, DuPage, Kane,
10Lake, McHenry, and Will, the townships of Aux Sable and Goose
11Lake in Grundy County, and the township of Oswego in Kendall
12County.
13    "Electric vehicle" means a vehicle that is exclusively
14powered by and refueled by electricity, must be plugged in to
15charge, and is legally permitted licensed to drive on all
16public roadways, including interstate highways. "Electric
17Vehicle" does not include electric mopeds, electric
18off-highway vehicles primarily intended to be driven
19off-highway, including golf carts and electric vehicles with a
20maximum speed below 45 miles per hour, or hybrid electric
21vehicles and extended-range electric vehicles that are also
22equipped with conventional fueled propulsion or auxiliary
23engines.

1    "Eligible applicant" means persons and families whose
2income does not exceed 500% of the federal poverty line for the
3current State fiscal year and who may not be claimed as a
4dependent.
5    "Eligible vehicle" means an electric vehicle, as defined
6by this Act, with a selling price not exceeding $80,000 as
7shown on the bill of sale, that has not previously received a
8rebate under this Act. For the purposes of this Act, State and
9local taxes, license and registration fees, documentary
10service fees, and aftermarket products, including, but not
11limited to, extended warranties, service contracts, and other
12voluntary vehicle protection products, are excluded from the
13calculation of the selling price if separately itemized on the
14bill of sale.
15    "Environmental justice community" has the same meaning,
16based on existing methodologies and findings, used and as may
17be updated by the Illinois Power Agency and its Program
18Administrator of the Illinois Solar for All Program.
19    "Low-income applicants Low income" means persons and
20families whose income does not exceed 80% of the regional or
21county State median income for the current State fiscal year,
22as established by the United States Department of Housing and
23Urban Development's Illinois Income Limits by metropolitan
24area and county Health and Human Services.

2    Sec. 15. Rulemaking. The Agency shall adopt promulgate
3rules as necessary and dedicate sufficient resources to
4implement Section 27 of this Act. Such rules shall be
5consistent with applicable provisions of the Clean Air Act and
6any regulations promulgated pursuant thereto. The Secretary of
7State may adopt promulgate rules to implement Section 35 of
8this Act.

12    Sec. 27. Electric vehicle rebate.
13    (a) Beginning July 1, 2022, and continuing as long as
14funds are available, each eligible applicant person shall be
15eligible to apply for a rebate, in the amounts set forth below,
16following the purchase of an eligible electric vehicle in
17Illinois. The Agency shall accept applications and issue
18rebates consistent with the provisions of this Act and any
19implementing regulations adopted by the Agency. In no event
20shall a rebate amount exceed the purchase price of the
21vehicle.
22        (1) Beginning July 1, 2025 2022, a $2,000 $4,000
23    rebate for eligible applicants toward the purchase of a
24    new or used an electric vehicle that is not an electric
25    motorcycle and a $1,500 rebate for the purchase of an

1    electric vehicle that is an electric motorcycle.
2    Low-income applicants are eligible for an additional
3    $2,000 rebate for new or used vehicles that are not
4    electric motorcycles.
5        (2) (Blank). Beginning July 1, 2026, a $2,000 rebate
6    for the purchase of an electric vehicle that is not an
7    electric motorcycle.
8        (3) Beginning July 1, 2028, a $1,500 rebate for
9    eligible applicants toward the purchase of a new or used
10    an electric vehicle that is not an electric motorcycle and
11    a $750 rebate for the purchase of an electric vehicle that
12    is an electric motorcycle. Low-income applicants are
13    eligible for an additional $1,500 for new or used vehicles
14    that are not electric motorcycles.
15        (4) (Blank). Beginning July 1, 2022, a $1,500 rebate
16    for the purchase of an electric vehicle that is an
17    electric motorcycle.
18    (b) To be eligible to receive a rebate, a purchaser must:
19        (1) Reside in Illinois, both at the time the vehicle
20    was purchased and at the time the rebate is issued.
21        (2) Purchase an electric vehicle in Illinois on or
22    after July 1, 2022 and be the owner of the vehicle at the
23    time the rebate is issued. Rented or leased vehicles,
24    vehicles purchased from an out-of-state dealership, and
25    vehicles delivered to or received by the purchaser
26    out-of-state are not eligible for a rebate under this Act.

1        (3) Apply for the rebate within 180 90 days after the
2    vehicle purchase date, and provide to the Agency proof of
3    residence, proof of vehicle ownership, and proof that the
4    vehicle was purchased in Illinois, including a copy of a
5    purchase agreement noting an Illinois seller. The
6    purchaser must notify the Agency of any changes in
7    residency or ownership of the vehicle that occur between
8    application for a rebate and issuance of a rebate.
9        (4) Apply for the rebate during an open rebate cycle,
10    as identified by the Agency.
11        (5) Certify that the purchaser qualifies as an
12    eligible applicant and a low-income applicant, if
13    applicable.
14    (c) The Agency shall make available in application
15materials methods for purchasers to identify as low-income
16applicants. The Agency shall prioritize the review of
17qualified applications from low-income applicant purchasers
18and award rebates to qualified purchasers accordingly.
19    (d) The purchaser must retain ownership of the vehicle for
20a minimum of 12 consecutive months immediately after the
21vehicle purchase date. The purchaser must continue to reside
22in Illinois during that time frame and register the vehicle in
23Illinois during that time frame. Rebate recipients who fail to
24satisfy any of the above criteria will be required to
25reimburse the Agency all or part of the original rebate amount
26and shall notify the Agency within 60 days of failing to

1satisfy the criteria.
2    (e) Rebates administered under this Section shall be
3available for both new and used electric vehicles.
4    (f) A rebate administered under this Act may only be
5applied for and awarded one time per vehicle identification
6number. A rebate may only be applied for and awarded once per
7purchaser in any 10-year period.
8    (g) For program auditing purposes, the Agency may request
9from a rebate recipient additional information and
10documentation evidencing eligibility for a rebate issued on or
11after July 1, 2025, including copies of income tax returns
12that corroborate the certification referenced in paragraph (5)
13of subsection (b). If requested by the Agency, a rebate
14recipient shall provide the information and documentation
15within the timeframe specified in the Agency's request. If the
16rebate recipient fails to provide the information and
17documentation requested by the Agency by the specified
18deadline, or if the information and documentation provided
19evidences that the rebate recipient was not eligible for the
20rebate or the rebate recipient fails to corroborate the
21certification referenced in paragraph (5) of subsection (b),
22the rebate recipient may be required to reimburse the Agency
23all or part of the original rebate amount.

1    Sec. 40. Appropriations from the Electric Vehicle Rebate
2Fund.
3    (a) The Agency shall estimate the amount of user fees
4expected to be collected under Section 35 of this Act for each
5fiscal year. User fee funds shall be deposited into and
6distributed from the Electric Vehicle Rebate Fund in the
7following manner:
8        (1) Through fiscal year 2023, an annual amount not to
9    exceed $225,000 may be appropriated to the Agency from the
10    Electric Vehicle Rebate Fund to pay its costs of
11    administering the programs authorized by Section 27 of
12    this Act. Beginning in fiscal year 2024 and in each fiscal
13    year thereafter, an annual amount not to exceed $600,000
14    may be appropriated to the Agency from the Electric
15    Vehicle Rebate Fund to pay its costs of administering the
16    programs authorized by Section 27 of this Act. An amount
17    not to exceed $225,000 may be appropriated to the
18    Secretary of State from the Electric Vehicle Rebate Fund
19    to pay the Secretary of State's costs of administering the
20    programs authorized under this Act.
21        (2) In fiscal year 2022 and each fiscal year
22    thereafter, after appropriation of the amounts authorized
23    by item (1) of subsection (a) of this Section, the
24    remaining moneys estimated to be collected during each
25    fiscal year shall be appropriated.
26        (3) (Blank).

1        (4) Moneys appropriated to fund the programs
2    authorized in Sections 25 and 30 shall be expended only
3    after they have been collected and deposited into the
4    Electric Vehicle Rebate Fund.
5    (b) Amounts General Revenue Fund amounts appropriated to
6and deposited into the Electric Vehicle Rebate Fund from the
7General Revenue Fund, or any other fund, shall be distributed
8from the Electric Vehicle Rebate Fund to fund the program
9authorized in Section 27.
