Synopsis As Introduced Creates the Human Trafficking Resource Center Notice Act. Provides that specified businesses and establishments shall post in a conspicuous place a notice informing the public of the availability of the National Human Trafficking Resource Center. Contains provisions regarding the form and substance of the notice. Directs the Department of Human Services to develop and post on its website a model notice. Provides that a business or establishment that fails to comply with the requirements of the Act is liable for a civil penalty of $500 for a first offense and $1,000 for each subsequent offense.
House Floor Amendment No. 1 Removes businesses or establishments that offer massage or bodywork services for compensation from the list of businesses and establishments that are required to place a notice informing the public of the availability of the National Human Trafficking Resource Center.
Senate Floor Amendment No. 1 Replaces everything after the enacting clause. Inserts provisions similar to the engrossed bill with the following additions. Provides that "farm labor contractor" means: (i) any person who for a fee or other valuable consideration recruits, supplies, or hires, or transports in connection therewith, into or within the State, any farmworker not of the contractor's immediate family to work for, or under the direction, supervision, or control of, a third person; or (ii) any person who for a fee or other valuable consideration recruits, supplies, or hires, or transports in connection therewith, into or within the State, any farmworker not of the contractor's immediate family, and who for a fee or other valuable consideration directs, supervises, or controls all or any part of the work of the farmworker or who disburses wages to the farmworker. Provides that "farm labor contractor" does not include full-time regular employees of food processing companies when the employees are engaged in recruiting for the companies if those employees are not compensated according to the number of farmworkers they recruit. Provides that the Department of Human Services may comply with the requirement to develop a model notice by adopting a model notice developed by the Illinois Task Force on Human Trafficking that complies with the requirements of the Act.
