Synopsis As Introduced Amends the Consumer Fraud and Deceptive Business Practices Act. Makes a technical change in a Section concerning the short title.
Replaces everything after the enacting clause. Amends the Automatic Telephone Dialers Act and the Restricted Call Registry Act. Provides that a consumer is entitled to statutory damages of $500 for each violation of the Act. Requires persons who make calls to communicate a commercial message subject to those Acts to maintain records of calls made and documentation supporting any exemption claimed under the Acts. Effective immediately.
House Floor Amendment No. 1 Provides that records of commercial messages need be kept only for 24 months. Limits enforcement actions by subscribers to only residential subscribers. Limits period within which to bring an enforcement action to one year from when the subscriber knew or should have know of the violation or one year after the termination of certain other enforcement actions arising out of the same violation.
