Synopsis As Introduced
Amends the Nursing Home Care Act. Provides that an owner or operator of a facility shall purchase and maintain not less than $500,000 in liability insurance for each facility. Provides that no person may establish, own, or operate a facility in the State unless and until the person provides proof of liability insurance coverage to the Department of Public Health. Provides that the Department shall issue a license if the applicant and the facilities meet specified requirements. Provides that each application for a license for a facility shall be accompanied by a license fee of $20 for each bed in the facility, with a minimum fee per facility of $200 (instead of an annual fee of $1,990). Provides that an application for a license to operate a facility also shall include affirmative evidence of the ability to comply with the liability insurance requirement. Effective immediately.

 HB 6243 would neither increase nor decrease the number of judges needed in the State.

 There are no penalty enhancements associated with HB 6243. The bill would have no fiscal or population impact on the Department. of Corrections.

 HB 6243 does create a State mandate.

 This bill will have no effect on the cost of constructing, purchasing, owning, or selling a single-family residence.

 Fiscal Note (Dept. of Revenue)
 The Illinois Department of Revenue has no data that would allow it to determine the fiscal impact of HB 6243.

 Balanced Budget Note (Office of Management and Budget)
 The fiscal impact of HB 6243 cannot be determined at this time. However, it should be noted that there is potential for a decrease in revenue due to the change in the Long Term Care licensing fees. Further analysis by the Department of Healthcare and Family Services will need to be done to determine the maximum licensing fees allowed by Federal government rules and regulations.

 Fiscal Note (Dept. of Healthcare & Family Services)
 Because the fee, as described, would be an impermissible tax under the federal Medicaid law, the amount of tax collected would be deducted from the federal claim. Therefore, the State would lose $0.50 in FFP for every $1.00 collected. The net benefit to the State is only half the tax collected.

 Fiscal Note (Dept. of Public Health)
 The proposed fee structure is a minimum of $50 to a maximum of $5000. The plan review process is supposed to be self sustaining and dropping the fees will cause staff problems and also delays in plan review times.
