Deletes everything after the enacting clause. Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Creates the Center for Comprehensive Health Planning to promote the distribution of health care services and improve the healthcare delivery system in Illinois by establishing a statewide Comprehensive Health Plan and ensuring a predictable, transparent, and efficient Certificate of Need process under the Illinois Health Facilities Planning Act. Amends the Illinois Health Facilities Planning Act. Replaces the 5-member Health Facilities Planning Board with a 9-member Health Facilities and Services Review Board. Provides that prior to March 1, 2010, the Health Facilities Planning Board shall establish a plan to transition its powers and duties to the Health Facilities and Services Review Board. Makes changes in provisions concerning the purposes of the Act; definitions; ex parte communication; construction, modification, or establishment of health care facilities or acquisition of major medical equipment; application for permits or exemption from application; powers and duties of the State Board and its staff; revision of criteria, standards, and rules; penalties; and an audit by the Auditor General. Includes in the definition of "capital expenditure minimum", $6,500,000 for applicants for projects related to skilled and intermediate care long-term care facilities. Adds provisions concerning Safety Net Impact Statements and creating the Nomination Panel, which provides a list of candidates to the Governor for appointment to Illinois Health Facilities and Services Review Board, the position of Chairman of the Board, and the Comprehensive Health Planner. Extends the repeal of the Act from July 1, 2009 to December 31, 2019. Repeals provisions concerning areawide health planning organizations, certificates of recognition, and the Task Force on Health Planning Reform. Makes related changes in other Acts. Effective immediately.

House Committee Amendment No. 1
Exempts facilities operating as children's respite care centers (instead of community-based residential rehabilitation centers) from the Act. Deletes a provision requiring that no person shall be appointed as a State Board member if that person has served, after June 27, 2003, 2 3-year terms as a State Board member, except for ex officio non-voting members. Provides that the Governor may reappoint a State Board member for additional terms. Deletes language allowing the Director to make certain findings under the provision concerning application for permit or exemption and exemption regulations. Provides that in connection with a change of ownership of a health care facility, the State Board may approve the transfer of an existing permit without regard to whether the permit to be transferred has yet been obligated, except for permits establishing a new facility or a new category of service. Provides that the staff of the State Board shall prepare a written copy of the final decision to approve or deny an application and the State Board shall approve a final copy for inclusion in the formal record. Provides that the Auditor General shall commence a performance audit 24 months (instead of 18 months) after the last member of the 9-member Board is appointed and 36 months thereafter. Provides that a person who knowingly provides false or misleading information on the application or knowingly fails to disclose a communication required to be disclosed is disqualified from nomination (instead of guilty of a Class 4 felony).

House Committee Amendment No. 2
In the provision concerning the powers and duties of the State Board, provides that the Chairman of the Board shall appoint a permanent Health Services Review Board Long-term Care Facility Advisory Subcommittee that shall develop and recommend to the Board the rules to be established by the Board concerning certain guidelines for long-term care. Provides that the Board and the Subcommittee shall study new approaches to the current bed need formula and Health Service Area boundaries to encourage flexibility and innovation in design models reflective of the changing marketplace and consumer preferences. Provides that the Board shall file the proposed related administrative rules for the separate rules and guidelines for long-term care by September 1, 2010. Provides that the Subcommittee shall be provided a reasonable and timely opportunity to review and comment on any review, revision, or updating of the criteria, standards, procedures, and rules used to evaluate project applications prior to approval by the Board and promulgation of related rules.

House Floor Amendment No. 5
Deletes reference to:

Deletes references to the Special Nomination Panel. Provides that a Board member's re-appointment to the Board shall be subject to review and re-approval every 3 years. Provides that the Governor shall designate one of the Board members to serve as the Chairman of the Board (instead of shall separately appoint from a list of nominees selected by the Special Nomination Panel).

Governor Amendatory Veto Message
Recommends the following: removes provisions requiring the payment of the chairman and board members of the Health Facilities and Services Review Board; removes provisions requiring the fining of board members for unexcused absences from board meetings; and corrects a reference to the Health Facilities and Services Review Board and a subsection cross-reference.
