Synopsis As Introduced
Amends the Wildlife Code. Provides that no permit or license may be issued, for the taking with a firearm of wildlife protected under the Code, to any convicted felon, any person subject to an order of protection prohibiting him or her from possessing a firearm, any person convicted within the previous 5 years of battery, assault, aggravated assault, or violation of an order of protection in which a firearm was used or possessed, any person convicted of domestic battery on or after the effective date of the amendatory Act, any person convicted within the previous 5 years of domestic battery committed before the effective date of the amendatory Act, or any person not an adult who had been adjudicated a delinquent minor under the Juvenile Court Act of 1987 for the commission of an offense that if committed by an adult would be a felony.

Senate Floor Amendment No. 2
Adds reference to:
520 ILCS 5/2.33c new

Replaces everything after the enacting clause. Reinserts the provisions of the introduced bill with changes. Provides that permits or licenses are not valid (instead of may not be issued) for the taking of wildlife with a firearm by specified criminal offenders. Provides for the Department to require all applicants for firearm deer permits or firearm turkey permits to swear, under penalty of perjury, that they do not fit any of the prohibited categories. Provides that an applicant who falsely swears or who is found hunting after he or she fits into a prohibited category is subject to penalties, including suspension of hunting privileges for 5 years.

House Committee Amendment No. 1
Further amends the Wildlife Code. Provides that there is no rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.

House Floor Amendment No. 3
Adds reference to:
520 ILCS 5/1.13from Ch. 61, par. 1.13

Replaces everything after the enacting clause. Amends the Wildlife Code. Authorizes the Department to assess a "Public Hunting Grounds for Pheasants" fee that is $25 for residents and $35 for non-residents in 2008. The "Public Hunting Grounds for Pheasants" fee increases by $5 every third year until the maximum fee is $50 for residents and $60 for non-residents, and it takes the place of the $15 "Public Hunting Grounds for Pheasants" stamp. Imposes conditions on any rulemaking authority. Effective immediately.
