Synopsis As Introduced
Amends the Check Cashing Act. Limits the amount of the penalty that a casino-based electronic check cashing service may recover from a person who writes a check that is dishonored.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Reinserts the bill as introduced with the following changes. In the definition of "casino-based electronic check acceptance service", provides that the service must be performed as part of a transaction involving a check that takes place on a riverboat subject to the Riverboat Gambling Act, or in a facility associated with the riverboat located within 1,000 feet of the riverboat (was, within 1,000 feet of any such riverboat). Provides that, if a casino-based electronic check acceptance service has taken part in a casino-based transaction involving a check that is dishonored, then a casino-based electronic check acceptance service may not recover treble damages from a person who writes a check for use in a casino-based transaction that is dishonored (removes language concerning recovery of actual damages plus a fee). Provides that there is no rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.
