Synopsis As Introduced
Amends the Department of Revenue Law of the Civil Administrative Code of Illinois and the Riverboat Gambling Act. Separates the Illinois Gaming Board from the Department of Revenue for the purposes of enforcing and administering the Riverboat Gambling Act. Makes conforming changes. In provisions concerning the powers and duties of the Board, removes language allowing the Director of Revenue to delegate responsibility for the administration and enforcement of certain Acts concerning gaming to the Board and adds language concerning appointing investigators. Makes changes concerning appropriations from the State Gaming Fund. Makes other changes. Amends the Executive Reorganization Implementation Act. Excludes the Illinois Gaming Board from the definition of "agency directly responsible to the Governor". Amends the State Employees Article of the Illinois Pension Code. Adds investigators for the Illinois Gaming Board to provisions concerning the alternative formula. Effective immediately.

House Committee Amendment No. 1
In provisions of the Riverboat Gambling Act concerning the powers and duties of the Illinois Gaming Board, (i) reinserts provisions concerning appointment of investigators with the following changes: adds that the appointment power is "as deemed necessary by the Board" and removes language requiring the Board to issue each investigator a badge and (ii) adds provisions allowing the Board to contract with the Department of State Police and the Department of Revenue for the use of trained and qualified personnel to conduct investigations, searches, seizures, arrests, and other duties imposed under the Act (and allows for appropriations to the Department of Revenue for this purpose). Changes the effective date to July 1, 2007 (was, effective immediately).

 HB 24 (H-AM 1) based on Gaming Board staffing recommendations, the Illinois Gaming Board would need an additional $4,340,000 for additional investigators, administrative staff, and additional support.

 HB 24 (H-AM 1) would neither increase nor decrease the number of judges needed in the State.

 Balanced Budget Note, House Committee Amendment No. 1 (H-AM 1)(Office of Management and Budget)
 The Governor's Office of Management and Budget estimates that this legislation, since effective July 1, 2007, would have no budgetary impact to the Fiscal Year 2007 budget. Fiscal Year 2007 appropriations for the Illinois Gaming Board are $18.7 million from the State Gaming Fund. However, using FY2007 as a model, if enacted into law, in Fiscal Year 2008 this legislation would require additional appropriations estimated between $1.5 million to $2.0 million, which could result in a budget which is not balanced. In addition, the alternative pension formula is more expansive than the current pension formula, so adding additional employees to this formula will have a long term impact on the balanced budget.
