Synopsis As Introduced
Amends the Civil Administrative Code of Illinois. Makes a technical change in a Section concerning the short title of the Code.

Replaces everything. Creates the African-American HIV/AIDS Response Act and amends the Illinois Public Aid Code. Provides that an African-American HIV/AIDS Response Officer, responsible for coordinating efforts to address the African-American AIDS crisis within his or her respective Office or Department and serving as a liaison to governmental and non-governmental entities beyond his or her respective Office or Department regarding the same, shall be designated in each of the following: (1) the Office of the Governor; (2) the Department of Human Services; (3) the Department of Public Health; and (4) the Department of Corrections. Provides that a State agency that operates a facility that (i) is accessible to the public, (ii) is a high-traffic facility, and (iii) serves a high-risk community must provide the following in each such facility where space and security reasonably permit: space for free HIV counseling and antibody testing, in accordance with the AIDS Confidentiality Act and rules adopted by the Department of Public Health. Provides that neither the State of Illinois nor any State agency supplying space for such counseling and testing services shall be liable for damages based on the provision of such space or claimed to result from any services performed in such space, except that this immunity does not apply in the case of willful and wanton misconduct. Requires that IDPH and CMS issue proposed rules by January 15, 2005. Provides for Medicaid eligibility for persons living with HIV/AIDS, subject to federal approval, and provides that the Department of Public Aid shall seek federal approval to expand access to health care for such persons. Provides an exemption from the requirement that a TANF recipient participate in education, training, or employment programs if a physician determines that such participation may threaten the recipient's life or health or that the recipient has a temporary incapacity that is health-related in whole or in part.

 Fiscal Note (Department of Public Health)
 As amended by HA1, has no fiscal impact on the Illinois Department of Public Health.

 Fiscal Note (Department of Public Aid)
 As amended by HA1, annual costs are projected between $16.7-$33.5 million based on an estimated range of 50%-100% enrollment in the Medicaid program.

 Fiscal Note (Department of Human Services)
 As amended by HA1, cost is $860,000 to $2.7 million.
