Synopsis As Introduced
Amends the Juvenile Court Act of 1987 and the Code of Criminal Procedure of 1963. Provides that for any offense alleged to have been committed on or after July 1, 2004, the lineup identification procedure shall be presented in the sequential method, in which a witness is shown lineup participants one at a time. Provides that the witness shall be requested to state whether the individual shown is the person accused of a violation of law, prior to viewing the next lineup participant. Provides that only one member of the lineup shall be a suspect, and the remainder shall be "fillers" who are not suspects, but fit the general description of the suspect.

Deletes all. Provides that the sequential line up procedures shall be established by the Department of State Police in 3 police departments as a pilot project. Provides that one pilot jurisdiction shall be a police district within a municipality of over 500,000, one in a police department in a municipality with a population greater than 100,000 but less than 500,000 and one in a police department in a municipality of less than 100,000. Provides that the jurisdictions shall be selected no later than January 1, 2004. Effective immediately.

Deletes all. Amends the Juvenile Court Act of 1987. Eliminates from the provisions requiring adult criminal prosecution the commission of an offense by a minor at least 15 years of age at the time of the offense: (1) who commits an armed robbery with a firearm or aggravated vehicular hijacking with a firearm; (2) who commits certain controlled substance violations on certain property; or (3) who commits certain unlawful use of weapons offenses on school property. Effective immediately.
