Synopsis As Introduced
Amends the Disabled Persons Rehabilitation Act. Removes persons with Alzheimer's disease and related disorders from the list of persons receiving services under the Act. Changes the type of preventive services the Department may establish to prevent the unnecessary institutionalization of persons in need of long term care who meet the criteria for blindness or disability as defined under the Social Security Act. Removes language allowing the Department to base eligibility standards on the recipient's ability to pay. Removes language concerning the Department's authority to establish a system of recipient cost sharing; provider vouchers; interest payments to providers of chore and housekeeping services; and other matters. Effective immediately.

Senate Committee Amendment No. 1
Replaces everything after the enacting clause and reinserts similar provisions with the following changes: adds home health services and electronic response to the list of services the Department of Human Services may include in its program of services to prevent the unnecessary institutionalization of persons in need of long term care. Restores language concerning the recovery of moneys expended for services provided to or in behalf of a person by a claim against the person's estate or against the estate of the person's surviving spouse, with certain limitations. Provides that "to the extent permitted under the federal Social Security Act," the Department, or the Department's authorized representative, may recover such moneys. Effective immediately.

Senate Floor Amendment No. 2
In regard to eligibility standards for services to prevent the unnecessary institutionalization of persons in need of long term care and who meet the criteria for blindness or disability as defined by the Social Security Act, restores language imposing a $10,000 asset limit and removes language providing that a person's assets may not exceed the amount of assets established by the Department of Human Services by rule. Adds language providing that if the asset limit has been increased by rule and the Department subsequently requires a decrease in the asset limitation, that authority shall be authorized by rule but the limitation shall not be less than $10,000.

House Committee Amendment No. 1
Replaces everything after the enacting clause. Reinserts the provisions of the engrossed bill with the following changes. In regard to eligibility standards for services to prevent the unnecessary institutionalization of persons in need of long term care and who meet the criteria for blindness or disability as defined by the Social Security Act, restores language providing that such eligibility standards may be based on the recipient's ability to pay for services; provided, however, that any portion of a person's income that is equal to or less than the "protected income" level shall not be considered by the Department of Human Services in determining eligibility. In regard to the asset limitation, provides that the Department may increase or decrease (rather than increase) the asset limitation by rule, and that the Department may not decrease the asset level below $10,000. Restores a provision granting the Department the authority to establish a system of recipient cost-sharing for services. Effective immediately.

House Floor Amendment No. 2
Further amends the Disabled Persons Rehabilitation Act. Provides that the Department of Human Services' program of preventative services to avoid the unnecessary institutionalization of Alzheimer's patients or blind or disabled persons in need of long term care include (instead of may include, but are not limited to,) any or all of 12 specified services.
