Illinois General Assembly - Bill Status for HB3945

Amends the Illinois Vehicle Code. Removes language providing that certain multiple offenders shall not be eligible for the issuance of a restricted driving permit. Provides that the Secretary of State may not issue a restricted driving permit, until a period of one year after the date of the most recent revocation, to any person whose current revocation is the result of a second or third (instead of second or subsequent) conviction for driving under the influence or involuntary manslaughter or reckless homicide where the use of alcohol or other drugs is recited as an element of the offense. Provides that the Secretary may not issue a restricted driving permit to any person whose current revocation is the result of a fourth or subsequent conviction for driving under the influence or involuntary manslaughter or reckless homicide where the use of alcohol or other drugs is recited as an element of the offense, or any combination of those offenses, until the expiration of at least 3 years from the date of revocation. Removes language providing that a person may not make application for a license if convicted of committing a fourth or subsequent violation of driving under the influence, fleeing from a motor vehicle accident involving death or personal injuries, involuntary manslaughter or reckless homicide, or a combination of those offenses.

Replaces everything after the enacting clause. Amends the Criminal Identification Act. Provides that a record for a non-felony violation of reckless driving may be ordered sealed after an offender reaches the age of 25 years, if the arrest or charge occurred prior to the offender reaching the age of 25 years and the offender has no other conviction for driving under the influence or reckless driving. Amends the Illinois Vehicle Code. Provides that certain persons ineligible to re-apply for a license may instead apply for a restricted driving permit after the expiration of 3 years from the effective date of the most recent revocation, provided the person proves by clear and convincing evidence a minimum 3 years of uninterrupted sobriety from alcohol and other drugs and the successful completion of all rehabilitative activity recommended by a properly licensed service provider. Provides that the Secretary of State shall cancel a restricted driving permit issued under the conditions if the holder fails to comply with the interlock ignition device requirements and that such a person shall be ineligible to re-apply for restricted driving privileges.

Provides that a bona fide resident of a foreign jurisdiction who would be eligible for a restricted driving permit under the provisions of House Amendment No. 2 if the person were a resident of Illinois may make application for termination of the revocation after a period of 10 years from the effective date of the most recent revocation. Provides that if a person who has been granted a termination of revocation subsequently becomes a resident, the revocation shall be reinstated and the person shall be subject to the provisions concerning the issuance of a restricted driving permit.
