Amends the Affordable Housing Planning and Appeal Act. Makes a technical change in a Section concerning the short title.

Replaces everything after the enacting clause. Amends the Affordable Housing Planning and Appeal Act. Changes "for-sale units" to "owner-occupied units". Provides that beginning on the effective date of this amendatory Act (rather than beginning October 1, 2004), the Illinois Housing Development Authority shall publish a list of exempt and non-exempt local governments and the data that it used to calculate its determination at least once every 5 years (rather than shall publish on an annual basis a list of exempt and non-exempt local governments and the data that it used to calculate its determination). Provides that in the case of local governments that are determined by the Illinois Housing Development Authority to be non-exempt for the first time based on the recalculation of U.S. Census Bureau data (rather than decennial census data) after the effective date of this amendatory Act (rather than after 2010), no developer may appeal to the State Housing Appeals Board until 60 months after a local government has been notified of its non-exempt status. Provides that beginning on the effective date of this amendatory Act (rather than beginning January 1, 2009), the Board shall, whenever possible, render a decision on the appeal within 120 days after the appeal is filed. Provides that the Board may extend the time by which it will render a decision where circumstances outside the Board's control make it infeasible for the Board to render a decision within 120 days. In a provision concerning appeals to the appellate court of a final ruling by the State Housing Appeals Board, provides that the appellate court shall apply the "clearly erroneous" standard when reviewing such appeals; and that such appeals shall be filed within 35 days after the Board's decision and in all respects shall be in accordance with a specified provision under the Code of Civil Procedure. In a provision concerning members of the Housing Appeals Board, provides that after a member's term expires, the member shall continue to serve until a successor is appointed; and that there shall be no limit to the number of terms an appointee may serve. Effective immediately.
