Synopsis As Introduced
Amends the Environmental Protection Act and the State Finance Act. Provides that white goods may not be disposed in a landfill unless the white goods components and recyclable components have been removed. Creates the White Goods Disposal Fund and the White Goods Recycling Fund as special funds in the State treasury, and provides that moneys in the Funds may be used for certain administrative purposes and for grants to certain manufacturers of products composed of recycled material. Requires retailers of white goods to collect a fee of $8 from the consumer for the purchase of white goods, and requires the retailer to pay all or a portion of that fee to the Department of Revenue for deposit into the White Goods Disposal Fund and the White Goods Recycling Fund. Sets forth provisions for the fee collections and returns by retailers. Provides that the amendatory Act does not authorize rulemaking. Effective immediately.

House Committee Amendment No. 1
Deletes provisions adopting the Illinois Administrative Procedure Act.

House Committee Amendment No. 2
Provides that no owner or operator shall "knowingly" accept any white goods or white goods components for final disposal.

House Committee Amendment No. 3
Deletes reference to:

Deletes everything after the enacting clause. Reinserts the provisions of the introduced bill and House Amendment 2 with changes: Prohibits (i) knowingly processing white goods by destruction or recycling unless the white good components have been removed and (ii) knowingly delivering a white good for destruction and recycling unless it has had the white good components removed and has the notification number of a registered white goods processor affixed to it. Requires that all white good components removed by a white goods processor must be managed as special waste under the Environmental Protection Act. Requires that any person who knowingly removes white good components from discarded white goods shall register with the Agency. Requires the Agency to assign a unique notification number to each facility. Creates the White Goods Recycling Fund and requires all penalties and punitive damages for white goods violations to be deposited into the Fund and used by the Agency to enforce the white goods provisions. Requires the Agency to report every 2 years. Deletes all provisions concerning retailer fees. Reinserts the language prohibiting rulemaking. Effective immediately.

 Fiscal Note, House Committee Amendment No. 3 (Illinois Environmental Protection Agency)
 This legislation will have no fiscal impact on the Illinois EPA.

House Floor Amendment No. 4
Provides that white goods may be delivered for destruction and recycling with white good components intact, "and without affixing a notification number of a registered white good processor", if the person accepting the white goods is registered and has received a notification number.

Senate Committee Amendment No. 1
Deletes the language providing that there is no rulemaking authority under the amendatory Act.
