Synopsis As Introduced
Amends the Illinois Insurance Code. Requires all companies issuing policies of automobile insurance to provide to a policyholder who submits certification of the completion of a course in the installation of a child restraint system a discount in the amount of 5% of the premium charges for the 6 months following receipt of the certification. Effective immediately.

Replaces everything after the enacting clause. Amends the Child Passenger Protection Act. Provides that a first violation of the Child Passenger Protection Act is a petty offense with a fine of $100 (rather than a fine of not more than $50), and a subsequent violation is a petty offense with a fine of $500 (rather than a fine of not more than $50) that may not be waived. Provides that the fine for a first violation of a provision concerning the transportation of a child in this State under the age of 8 years may be waived upon proof of possession of an approved child restraint system and proof of completion of a Child Passenger Safety Certification (CPSC) instructional course on the installation of a child restraint system (rather than just upon proof of possession of an approved child restraint system). Contains provisions describing the CPSC instructional course and the child restraint system inspection procedure.

House Floor Amendment No. 2
Provides that a person shall not be convicted (rather than the fine waived) of a first violation of the Child Passenger Protection Act that is a violation a provision concerning the transportation of a child in this State under the age of 8 upon proof of possession of an approved child restraint system and proof of completion of a Child Passenger Safety Certification (CPSC) instructional course on the installation of a child restraint system. Provides that the chief judge of each circuit may designate an officer of the court to review the documentation demonstrating that a person is in possession of an approved child restraint system and has completed a Child Passenger Safety Certification (CPSC) instructional course.

Senate Floor Amendment No. 1
Replaces everything after the enacting clause with the provisions of the engrossed bill and makes changes. Decreases the fines set by the engrossed bill from $100 to $75 for a first offense and from $500 to $200 for second offense of the of the Child Passenger Protection Act. Deletes references to "Child Passenger Safety Certification (CPSC)" in the engrossed bill. Provides that the instructional course shall include instruction on the proper installation of a child restraint system and an inspection of the child restraint system. Makes other changes.
