Synopsis As Introduced
Amends the Illinois Vehicle Code. Provides that the Department of Transportation and local authorities may issue permits allowing certain additional vehicles with weights exceeding normal limits to transport specified agricultural products over any highway except an interstate highway. Provides that the permit may be issued to a 3, 4, or 5 axle (as well as to a 2 axle) vehicle registered with the Secretary of State. Provides that the weight of a 3 or 4 axle vehicle may not exceed the normal weight limit by more than 20%, and the weight of a 5 axle vehicle may not exceed the normal limit by more than 10%. Provides that a vehicle may not exceed the license limits for that vehicle. Deletes language providing that these permits may authorize transport during the harvest season only. Provides that these vehicles may transport products from a storage facility (as well as from a field). Deletes language providing that the vehicle's destination must be a specified processing plant. Effective immediately.

Deletes everything after the enacting clause. Reinserts the provisions of the original bill and further amends the Illinois Vehicle Code. Provides that a vehicle transporting agricultural cash crops or loads of fruits or vegetables on a designated or non-designated highway, during the harvest season only, is in compliance with weight restrictions if its gross weight is less than 80,000 pounds and exceeds the permitted gross weight by not more than 10% and the vehicle is traveling from the field to the first point of storage, marketing, or processing. Provides that the operator of the vehicle must abide by posted bridge weight limits. Provides that the provision does not apply to the National System of Defense and Interstate Highways. Provides that the Department of State Police program to prevent the use of highways by overweight vehicles is non-discriminatory and is to be enforced in a non-discriminatory manner. Provides that the operator of a vehicle issued a special permit by the Department of Transportation must abide by posted bridge weight limits. Provides that a permit may be issued for a move of not more than 50 (rather than 25) miles from a field, storage, marketing, or processing facility (rather than from a field or storage facility). Effective immediately.

Deletes everything after the enacting clause. Reinserts the provisions of the bill as passed in the Senate, with changes, additions, and deletions. Deletes language regarding the Department of State Police overweight vehicles program. Deletes language providing that a vehicle transporting agricultural cash crops or loads of fruits or vegetables on specified highways during the harvest season only is in compliance with weight restrictions if certain conditions are met. Provides that agricultural commodities include livestock. Provides that a special permit may also be issued for a move of agricultural commodities from a livestock facility or warehouse. Changes the fee for a special permit for certain trucks hauling agricultural commodities (rather than hauling sweet corn and ensilage for a period of 40 days only during the harvest season) from $10 per vehicle to $5 per axle. Provides that an implement of husbandry operating on a special permit between sunset and sunrise must be equipped with the required lighting equipment. Effective immediately.
