Synopsis As Introduced
Amends the Department of Children and Family Services Powers Law of the Civil Administrative Code of Illinois, the Mental Health and Developmental Disabilities Administrative Act, the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois, the Department of Veterans Affairs Act, the Illinois Public Aid Code, and the Unified Code of Corrections. Provides that no nurse who is paid an hourly wage and who has direct responsibility to oversee or carry out nursing care or related duties may be required to work mandated overtime except in the case of an unforeseen emergent circumstance when such overtime is required only as a last resort, and limits the time of such overtime. Provides that when a nurse is mandated to work up to 12 consecutive hours, the nurse must be allowed at least 8 consecutive hours of off-duty time. Prohibits retaliation because a nurse refuses to work mandated overtime as prohibited under these provisions. Authorizes the filing of complaints alleging violations of these provisions. Effective immediately.

New Act

Replaces everything after the enacting clause. Creates the Task Force on State Employed Nurses Act. Creates a Facility Task Force on State Employed Nurses in each facility funded under the Department of Corrections, the Department of Juvenile Justice, the Department of Human Services, or the Department of Veterans' Affairs. Provides that the purpose of each Facility Task Force is minimizing mandatory overtime in Illinois' 24 hour direct care facilities. Provides for membership, meetings, and reports. Creates a State Task Force on State Employed Nurses to address the issue of minimizing mandatory overtime in Illinois' 24 hour direct care facilities. Provides that the State Task Force shall review the reports received by each agency as a result of the Facility Task Force meetings. Provides for Task Force membership, meetings, and a report. Effective immediately.

Replaces everything after the enacting clause. Amends Public Act 82-927. Deletes language providing that if the Village of Oswego ceases to occupy and use, in whole or in part, the land conveyed to it under that Act for a public use, the Village shall upon demand execute and deliver an instrument returning and vesting title of that land to the State of Illinois, Department of Transportation. Adds language providing that the Village of Oswego may sell the land and shall use the proceeds of any such sale for public purposes. Effective immediately.
